RESOLUTION 16-2913-B <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING <br />AMENDMENT #1 TO THE CONSTRUCTION AGREEMENT BETWEEN <br />THE CITY OF CASSELBERRY AND MURPHY PIPELINE <br />CONTRACTORS, INC. FOR CONSTRUCTION OF THE DOMMERICH <br />HILLS PIPE BURSTING PROJECT PHASE 2; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry competitively bid the Dommerich Hills Pipe <br />Bursting Project and awarded it to the lowest responsible bidder, Murphy Pipeline Contractors, Inc. <br />through the City Commission on December 14, 2015; and <br />WHEREAS, at the time of conducting the initial competitive process the solicitation <br />document included alternate bid items and associated language with the intent to award a Phase 2, if <br />deemed to be in the best interest of the City and if funds were secured; and <br />WHEREAS, Public Works staff budgeted funds in the FY 2017 budget to construct Phase <br />2 of this water main replacement project; and <br />WHEREAS, upon review and consideration City staff has deemed it to be in the best <br />interest of the City and recommends proceeding with award of Phase 2 of this project at the same <br />rate as originally submitted by Murphy Pipeline Contractors, Inc. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves <br />Amendment #1 to the Construction Agreement with Murphy Pipeline Contractors, Inc. for the not - <br />to -exceed amount of $1,433,516 and authorizes the Mayor to execute said document on behalf of <br />the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
