RESOLUTION 16-2913-B A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING AMENDMENT #1 TO THE CONSTRUCTION AGREEMENT BETWEEN THE CITY OF CASSELBERRY AND MURPHY PIPELINE CONTRACTORS, INC. FOR CONSTRUCTION OF THE DOMMERICH HILLS PIPE BURSTING PROJECT PHASE 2; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City of Casselberry competitively bid the Dommerich Hills Pipe Bursting Project and awarded it to the lowest responsible bidder, Murphy Pipeline Contractors, Inc. through the City Commission on December 14, 2015; and WHEREAS, at the time of conducting the initial competitive process the solicitation document included alternate bid items and associated language with the intent to award a Phase 2, if deemed to be in the best interest of the City and if funds were secured; and WHEREAS, Public Works staff budgeted funds in the FY 2017 budget to construct Phase 2 of this water main replacement project; and WHEREAS, upon review and consideration City staff has deemed it to be in the best interest of the City and recommends proceeding with award of Phase 2 of this project at the same rate as originally submitted by Murphy Pipeline Contractors, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves Amendment #1 to the Construction Agreement with Murphy Pipeline Contractors, Inc. for the not - to -exceed amount of $1,433,516 and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
