RESOLUTION 16-2905 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING A UTILITY EASEMENT <br />AGREEMENT WITH SNL INVESTMENT PROPERTIES; LLC ON <br />PARCEL ID #28-21-30-300-0520-0000; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, during review of redevelopment projects, the City occasionally comes across <br />utility lines located in areas that do not have recorded easements; and <br />WHEREAS, as these locations are identified, the City works with the property owner to <br />develop necessary easements, making it easier to perform essential maintenance work on the <br />existing utilities; and <br />WHEREAS, during development review of the proposed Biolife site development on S.R. <br />436, it was determined that the City does not have an easement for a City water line that runs along <br />the property line; and <br />WHEREAS, Public Works staff worked with SNL Investment Properties, LLC to <br />negotiate a favorable Utility Easement Agreement Parcel ID #28-21-30-300-052C-0000; and <br />WHEREAS, the utility easement will extend 10 feet into the property, which covers <br />where the water line is located, and will allow for sufficient space for future maintenance that may <br />need to be performed; and <br />WHEREAS, Public Works staff has reviewed the Utility Easement Agreement with SNL <br />Investment Properties, LLC and finds it favorable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Utility <br />Easement Agreement with SNL Investment Properties, LLC on Parcel ID #28-21-30-300-052C- <br />0000 (attached as Exhibit A) and authorizes the Mayor to execute said document on behalf of the <br />City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
