RESOLUTION 16-2906 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXECUTION OF A COOPERATIVE AGREEMENT WITH VARSITY COURTS, INC. FOR RECONSTRUCTION OF THE TENNIS COURTS AT SECRET LAKE PARK; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the tennis courts at Secret Lake Park are in dire disrepair and are cracked, faded, and have become a trip hazard to patrons; and WHEREAS, it is highly recommended that the tennis courts should be totally demolished, removed and reconstructed, including netting, fencing and lighting; and WHEREAS, Public Works wishes to enter into a Cooperative Agreement with Varsity Courts, Inc. to provide for the total demolition and reconstruction of the tennis courts at Secret Lake Park by "piggybacking" Orange County Public School's Contract number ITB 1307164; and WHEREAS, Public Works staff has reviewed the Cooperative Agreement with Varsity Courts, Inc., which is valid through August 26, 2017, for an amount not to exceed $110,369.50 and finds it favorable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the Cooperative Agreement with Varsity Courts, Inc. for an amount not to exceed $110,369.50 by "piggybacking" the Orange County Public School's Contract number IT131307164, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
