SECTION II. Recognizing Legislation in Progress. The City of Casselberry hereby <br />recognizes and confirms that legislation is in progress to adopt amendments to the Code of <br />Ordinances and the Land Development Code regarding the placement or installation of wireless <br />communications facilities and telecommunications towers and antennas, as defined by law, <br />within the City's public rights-of-way. Staff is directed not to issue any permits or Business Tax <br />Receipts for these facilities, or approve applications for building permits, development orders or <br />other land use activity within the City of Casselberry which would allow or permit the <br />construction of wireless facilities in the rights-of-way in conflict with the pending amendments. <br />General maintenance of lawful structures or accessory structures is exempted from the reach of <br />this Resolution, as are applications to replace lawfully existing structures, so long as the <br />structure, once replaced, complies with all provisions of the Code of the City of Casselberry. <br />SECTION III. CONFLICTS. All Resolutions or parts of Resolutions in conflict with <br />any provisions of this Resolution are hereby repealed to the extent of the conflict. <br />SECTION IV. SEVERABILITY. If any Section or portion of a Section of this <br />Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or <br />impair the validity, force, or effect of any other Section or part of this Resolution. <br />SECTION V. EFFECTIVE DATE.
