RESOLUTION 17-2953 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF A COOPERATIVE AGREEMENT WITH THE UNITED <br />STATES DEPARTMENT OF AGRICULTURE NATURAL RESOURCES <br />CONSERVATION SERVICE FOR GEE CREEK EROSION CONTROL; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE. <br />WHEREAS, the City of Casselberry experienced significant erosive damage within Gee <br />Creels as a result of Hurricane Matthew in October 2016; and <br />WHEREAS, the City Commission authorized City staff to submit an application to the <br />United States Department of Agriculture Natural Resources Conservation Service (USDA <br />NRCS) in an effort to obtain a grant to offset the costs associated with erosion control measures <br />at Gee Creek worsened by Hurricane Matthew; and <br />WHEREAS, the USDA NRCS has agreed to award the City funding to assist with the <br />erosion control at Gee Creek via a Cooperative Agreement; and <br />WHEREAS, said Agreement provides for a total budget of $1,128,633.60 which consists <br />of grant funding not to exceed $872,126.35 ($769,523.25 for construction and $102,603.10 for <br />technical assistance), and a required 25% funding match (or $256,507.25) from the City; and <br />WHEREAS, City staff has reviewed the Cooperative Agreement submitted by the <br />United States Department of Agriculture Natural Resources Conservation Services and finds it <br />favorable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />Cooperative Agreement with the United States Department of Agriculture Natural Resources <br />Conservation Service for Gee Creek erosion control, for a total grant maximum amount not to <br />exceed $872,126.35 and the required 25% funding match (or $256,507.25) from the City, and <br />authorizes the Mayor to execute said document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
