Ms. Hanna said the variance application <br />meets all six (6) criteria for granting the variance; therefore, staff supports the variance request as presented. <br />Ms. Hanna said if the Planning and Zoning Commission chooses to grant the sports lighting pole height <br />variance, BA 16-02, for property located on Seminola Boulevard within the Legacy Park Planned Development, the <br />motion should be based upon the Planning and Zoning Commission's findings of fact and conclusions, the staff <br />report dated September 14, 2016, the property site plan (Exhibit C), and the following conditions: <br />1. The sports lighting pole heights may not exceed 80 feet as provided in Table 1. <br />2. Lights shall be turned off immediately after a sporting event, or at 10:00 pm, whichever comes first. <br />3. In response to the Commission's question, Mr. Klima <br />said that the new lighting locations reduce the amount of light that needs to be cast on the tennis courts. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br />the request. Ms. Dori Sutter, 234 Morton Lane, Winter Springs, Florida came forward. Ms. Sutter said her property <br />abuts Geneva School on the east and expressed concerns with light trespass and esthetics. She questioned if the <br />40' poles could be used on the entire site. Mr. Henson explained the City Code regarding light trespass to the <br />adjacent properties. <br />Ms. Sutter said the tree line is the only buffer for the houses on the Winter Springs side and appreciated the <br />developer maintaining the natural buffer. Ms. Sutter said the tree line is much lower adjacent to the tennis courts and <br />was concerned with the light poles exceeding the tree line. Mr. Henson explained that the site meets the City Code <br />for light trespass. <br />Mr. Richard Dixon, 251 Morton Lane, Winter Springs, Florida came forward. Mr. Dixon made a correction to <br />the staff report on page 9, paragraph 2, stating the sports field light poles should not exceed 80'. <br />
