RESOLUTION 16 -2863 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF DEDUCTIVE CHANGE ORDER NO. 4 TO THE AGREEMENT WITH WHARTON- SMITH, INC. FOR CONSTRUCTION OF THE LAKE CONCORD PARK AND TRIPLET LAIC DRIVE SIGNATURE STREET PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, on March 9, 2015, the City Commission approved the Form of Agreement between Owner and Construction Manager (Construction Manager at Risk Services Agreement) with Wharton - Smith, Inc, for the Lake Concord Park and Triplet Lake Drive Signature Street projects; and WHEREAS, Wharton Smith submitted a Guaranteed Maximum Price (GMP) proposal to construct the required Lake Concord Park and the Triplet Lake Drive Signature Street project improvements in the amount of $10,416,587; and WHEREAS, the City Commission accepted the proposal and approved a GMP contract with Wharton -Smith on September 28, 2015 via Resolution 15 -2788; and WHEREAS, the City Commission approved Change Order No. 1 on January 11, 2016 via Resolution 16 -2820 in the amount of $316,308.90 for additional services to mitigate soil contamination in the Lake Concord Park project area; and WHEREAS, the City Commission approved Change Order No. 2 on February 22, 2016 via Resolution 16 -2832 in the amount of $10,608.02 to provide for re- routing conduit and fiber main connectivity within the existing Public Works Administration Building; and WHEREAS, the City Commission approved Change Order No. 3 on May 23, 2016 via Resolution 16 -2862 in the deductive amount of $16,296.49 which provided a credit for deletion of geogrid material for the proposed commercial parcels located within the Lake Concord Park project; and WHEREAS, Wharton -Smith has submitted Change Order No. 4 in the deductive amount of $23,514.21 which provides a credit for the deletion of a 7" concrete subslab related to placement of brick pavers for the Signature Street component of the Lake Concord Park project area; and WHEREAS, Public Works staff has reviewed the Wharton -Smith proposal for deductive Change Order No. 4 and finds it favorable to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS:
