RESOLUTION 16 -2863 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF DEDUCTIVE CHANGE ORDER NO. 4 TO THE <br />AGREEMENT WITH WHARTON- SMITH, INC. FOR CONSTRUCTION <br />OF THE LAKE CONCORD PARK AND TRIPLET LAIC DRIVE <br />SIGNATURE STREET PROJECTS; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, on March 9, 2015, the City Commission approved the Form of Agreement <br />between Owner and Construction Manager (Construction Manager at Risk Services Agreement) <br />with Wharton - Smith, Inc, for the Lake Concord Park and Triplet Lake Drive Signature Street <br />projects; and <br />WHEREAS, Wharton Smith submitted a Guaranteed Maximum Price (GMP) proposal to <br />construct the required Lake Concord Park and the Triplet Lake Drive Signature Street project <br />improvements in the amount of $10,416,587; and <br />WHEREAS, the City Commission accepted the proposal and approved a GMP contract <br />with Wharton -Smith on September 28, 2015 via Resolution 15 -2788; and <br />WHEREAS, the City Commission approved Change Order No. 1 on January 11, 2016 via <br />Resolution 16 -2820 in the amount of $316,308.90 for additional services to mitigate soil <br />contamination in the Lake Concord Park project area; and <br />WHEREAS, the City Commission approved Change Order No. 2 on February 22, 2016 via <br />Resolution 16 -2832 in the amount of $10,608.02 to provide for re- routing conduit and fiber main <br />connectivity within the existing Public Works Administration Building; and <br />WHEREAS, the City Commission approved Change Order No. 3 on May 23, 2016 via <br />Resolution 16 -2862 in the deductive amount of $16,296.49 which provided a credit for deletion of <br />geogrid material for the proposed commercial parcels located within the Lake Concord Park <br />project; and <br />WHEREAS, Wharton -Smith has submitted Change Order No. 4 in the deductive amount <br />of $23,514.21 which provides a credit for the deletion of a 7" concrete subslab related to placement <br />of brick pavers for the Signature Street component of the Lake Concord Park project area; and <br />WHEREAS, Public Works staff has reviewed the Wharton -Smith proposal for deductive <br />Change Order No. 4 and finds it favorable to the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
