RESOLUTION 16 -2864 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING THE USE OF CONTINGENCY <br />FUNDS AND AUTHORIZING THE EXECUTION OF CONTINGENCY <br />CHANGE ORDER NO. 1 FOR MISCELLANEOUS CONSTRUCTION <br />ISSUES RELATED TO THE PUBLIC 'WORKS ADMINISTRATION <br />BUILDING FOR THE LAKE CONCORD PARK AND TRIPLET LAKE <br />DRIVE SIGNATURE STREET PROJECTS; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, on March 9, 2015, the City Commission approved the Form of Agreement <br />between the Owner and Construction Manager (Construction Manager at Risk Services Agreement) <br />with Wharton - Smith, Inc. for the Lake Concord Park; and <br />WHEREAS, Wharton -Smith submitted a Guaranteed Maximum Price (GMP) proposal to <br />construct the required Lake Concord Park and the Triplet Lake Drive Signature Street project <br />improvements in the amount of $10,416,587; and <br />WHEREAS, the City Commission accepted the proposal and approved a GMP contract <br />with Wharton -Smith on September 28, 2015 via Resolution 15 -2788 ; and <br />WHEREAS, the GMP contained Contingency Funds of 5% for each of the separate <br />component projects within the overall project of which the Public Works Administration Building <br />is one of the separate projects with an established 5% Contingency Fund of $21,796.00; and <br />WHEREAS, there are three (3) miscellaneous construction issues related to the Public <br />Works Administration Building for which contingency fund requests have been submitted by <br />Wharton -Smith and listed in Contingency Change Order 4001: (1) %Z " DensGlass board to the <br />exterior of the building - $2,863.90; (2) temporary shoring for I -beams to maintain the structural <br />integrity of the existing building until a permanent wall is constructed - $1,205.90; and (3) new <br />meter cabinet, concrete meter post and a portable A/C unit to cool the existing IDF room during <br />permanent power switch over - $1,699.00; and <br />WHEREAS, the three contingency funds requests from the established GMP related <br />specifically to the Public Works Administration Building total $5,768.80 of which 5% contingency <br />funds of $21,796.00 are available; and <br />WHEREAS, Public Works staff has reviewed the Wharton -Smith contingency fund <br />requests and finds them favorable to the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
