ORDINANCE 16 -1440 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING SECTION 10 -1, DEFINITIONS OF THE CITY CODE OF <br />ORDINANCES, OF CHAPTER 10, ALCOHOLIC BEVERAGES, PART II, <br />TO INCLUDE A DEFINITION FOR "BOTTLE CLUB" AND <br />"EDUCATIONAL INSTITUTION "; REMOVING SECTION 10 -4, FIXING <br />HOURS OF SALE FOR NEW YEARS EVE; REMOVING SECTION 10 -6, <br />ADVERTISEMENT OF SUNDAY SALES; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE. <br />WHEREAS, educational institutions, both private and public, are conditionally permitted <br />in a majority of the City of Casselberry's zoning districts; and <br />WHEREAS, the City Commission determines it necessary to amend Section 10 -1 of <br />Chapter 10, Alcoholic Beverages, to include a definition for "educational institutions" for <br />purposes of defining distance separation from establishments serving alcohol, in order to prevent <br />a chilling effect on economic development which might occur if every educational institution, <br />regardless of size, is captured in the definition of educational institution; and <br />WHEREAS, the City Commission finds that bottle clubs operate pursuant to a business <br />model where patrons supply their own alcoholic beverages; and <br />WHEREAS, the City Commission finds that bottle clubs generally operate beyond the <br />hours bars and cocktail lounges are required by law to close; and <br />WHEREAS, due to the dangers of overconsumption of alcoholic beverages at bottle <br />clubs as well as the hours within which bottle clubs operate and the threats to public safety and <br />welfare such dangers present, the City Commission of the City of Casselberry finds it to be in the <br />interest of the health, safety and welfare of the citizens, businesses and visitors to the City of <br />Casselberry to provide a definition of "bottle club" and prohibit bottle clubs within the City; and <br />WHEREAS, the City Commission determines it necessary to remove requirements <br />within Section 10 -4, fixing the hours of sale for New Year's Eve alcohol sales; and <br />WHEREAS, the City Commission determines it necessary to remove the limitations <br />within Section 10 -6, restricting establishments from mentioning Sunday alcoholic beverage sales <br />in any type of advertisement; and <br />WHEREAS, words with double underlined type shall constitute additions to the original <br />text and stfike through shall constitute deletions to the original text, and asterisks (* * *) indicate <br />that text shall remain unchanged from the language existing prior to adoption of this Ordinance. <br />
