ORDINANCE 16 -1439 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY CODE, PART III, UNIFIED LAND <br />DEVELOPMENT REGULATIONS, TABLE 2 -5.3, LAND USE BY <br />DISTRICT, TO ALLOW MEDICAL MARIJUANA DISPENSARIES <br />AND MEDICAL MARIJUANA TREATMENT CENTERS AS A <br />CONDITIONAL USE WITHIN THE I (INDUSTRIAL) AND IM <br />(INDUSTRIAL- MEDIUM) ZONING DISTRICTS; AMENDING <br />ARTICLE VII "GENERAL REGULATIONS" TO ADD SECTION 2- <br />7.34 FOR MEDICAL MARIJUANA DISPENSARIES AND MEDICAL <br />MARIJUANA TREATMENT CENTERS; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE <br />DATE. <br />WHEREAS, the 2014 Florida Legislature approved Senate Bill 1030 providing for the <br />growing, processing, and distributing of specific forms of low -THC (non- euphoric) cannabis to <br />qualified patients and their caregivers for the treatment of listed medical conditions, which <br />became effective on June 16, 2014 as Chapter 2014 -157, Laws of Florida, and is codified at <br />Section 381.986, Florida Statutes ( "Senate Bill 1030 "); and <br />WHEREAS, the Florida Department of Health has adopted rules implementing Fla. Stat. <br />381.986; and <br />WHEREAS, despite the enactment of Fla. Stat. 381.986, the activities it condones <br />remain illegal under federal law; and <br />WHEREAS, on November 4, 2014, Florida voters narrowly rejected an amendment to <br />the Florida Constitution to allow for broader medical use of any kind of marijuana (including <br />euphoric strains) within the State; and <br />WHEREAS, as of September 2015, the Florida Division of Elections has approved <br />several proposed initiatives for placement on the November 2016 ballot proposing to amend the <br />Florida Constitution to authorize recreational use of cannabis, if the required number of <br />signatures are obtained to place the initiatives on the ballot; and <br />WHEREAS, in addition to the potential recreational initiatives, a medical marijuana <br />initiative is also gaining signatures for placement on the ballot for the November 2016 election, <br />which would amend the Florida Constitution to authorize medical marijuana (hereinafter the <br />"proposed 2016 ballot initiative "); and <br />
