RESOLUTION 14 -2645 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING EXECUTION OF A CONTRACT <br />FOR THE SALE AND PURCHASE OF SURPLUS PROPERTY AND A <br />QUITCLAIM DEED TO JOHN A, ZACCO; PROVIDNG FOR CONFLICTS, <br />SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry, via Resolution 08 -1938, established a process to surplus <br />and sell City -owned property; and <br />WHEREAS, property hereinafter described is no longer useful or needed as a public park or <br />access way to a public park and it is in the public interest that said property be abandoned and vacated as <br />a public park and as public property and be released from any and every public right, use, title and <br />interest; and <br />WHEREAS, via Resolution 14 -2583, the City -owned property identified as parcel # 09-21-30 - <br />513M- OA00 -00P1 in Sportsman's Paradise was declared surplus; and <br />WHEREAS, the City advertised for the sale of the surplus property on May 18, 2014, and only <br />received one bid for the property from John A. Zacco in the amount of $4,800.00. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission hereby approves said property hereinafter described is no <br />longer useful or needed as a public park or access way to a public park and it is in the public interest that <br />said property be abandoned and vacated as a public park and as public property and be released from any <br />and every public right, use, title and interest. <br />SECTION II. The City Commission hereby approves the sale of the property located at <br />Sportsman's Paradise, parcel # 09- 21- 30- 5BM- OA00 -OOP1, for the amount of $4,800.00 to John A. Zacco <br />and authorizes the Mayor to execute a Contract for Purchase and Sale and a Quitclaim Deed, attached <br />hereto, on behalf of the City Commission. <br />SECTION III. Conflicts. All Resolutions or parts of Resolution in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION IV. Severability. If any Section or portion of a Section of this Resolution proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br />SECTION V.
