CASSELBERRY CITY COMMISSION <br />Minutes of August 10, 2015 — Regular Meeting <br />Page 4 of 15 <br />CONCORD PARK PROJECT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE." <br />Introduction: Resolution 15 -2762 approves the Release of Landscape Maintenance Commitment Agreement <br />between Casselberry Investment Properties, Ltd. And the City of Casselberry for property located within theLake <br />Concord Park (City Center) Project, and authorizes the Mayor to execute said Release on behalf of the City. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Public Works Director recommended approval of Resolution 15- <br />2762. <br />E. Resolution 15 -2763 —Red Light Camera Litigation/Settlement Agreement (Johnsonv. City <br />ofCasselberiy et al.) and Related Budget Amendment #15 -050 <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />EXECUTION OF A STIPULATION AND AGREEMENT OF SETTLEMENT BETWEEN <br />MARIE H. JOHNSON AND THE CITY OF CASSELBERRY; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br />Introduction: Resolution 15 -2763 approves the Stipulation and Agreement of Settlement with Marie H. Johnson, <br />and others in the Red Light Camera litigation matter, a class action lawsuit styled Johnson v. Casselberry, Case <br />No. 09-CA-007307, in the amount of $98,946, and authorizes the City Attorney's office to execute said document <br />on behalf of the City, for filing with the Court. Consideration of related Budget Amendment #15 -050 is also <br />requested. <br />Budget Impact: The City must pay $98,946.00 of the revenue collected from red light camera violations during <br />the applicable time period. Depending on the volume of claims for reimbursement from class members some of <br />the funds may be refunded. <br />BA #15 -050 <br />Explanation of Request: This item seeks City Commission approval to provide a settlement in the Red Light <br />Camera litigation; a class action lawsuit styled Johnson v.
