ORDINANCE 07 -1217 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY OF CASSELBERRY COMPREHENSIVE PLAN <br />PURSUANT TO FLORIDA STATUTES, CHAPTER 163; PROVIDING FOR <br />ADOPTION OF TEXT AMENDMENTS, INCLUDING ADOPTING THE <br />POTABLE WATER ELEMENT, WATER SUPPLY FACILITIES WORK <br />PLAN AND 5 YEAR CAPITAL IMPROVEMENTS SCHEDULE 2007 — <br />2012 FOR THE CITY OF CASSELBERRY; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />WHEREAS, the Florida Legislature intends that local planning be a continuous and ongoing process; <br />and <br />WHEREAS, the City Commission has adopted the Comprehensive Plan, Ordinance No. 731 on <br />February 17, 1992 and was amended upon adoption of Ordinance No. 773 on October 4,1993; and <br />WHEREAS, Chapter 163, Florida Statutes, directs local governments to provide updates to various <br />portions of the Comprehensive Plan to address changing conditions and state policies and rules; and <br />WHEREAS, Section 163.3191, Florida Statutes, directs local governments to adopt needed <br />amendments to ensure that the plan provides appropriate policy guidance for growth and development; and <br />WHEREAS, the Planning and Zoning Board acting as the designated Local Planning Agency, <br />reviewed the Potable Water Element, Water Supply Facilities Work Plan, and 5 Year Capital Improvements <br />Schedule 2007 — 2012, held an advertised public hearing, provided for participation by the public in the <br />process, and rendered its recommendations to the City Commission; and <br />WHEREAS, The City Commission, on July 23, 2007, held an advertised public hearing, provided for <br />comments and public participation in the process in accordance with the requirements of state law and the <br />procedures adopted for public participation in the planning process, and transmitted the Potable Water <br />Element, Water Supply Facilities Work Plan, and 5 Year Capital Improvements Schedule 2007 — 2012 to the <br />Department of Community Affairs on September 1, 2007 for comment; and <br />WHEREAS, the Department of Community Affairs has now reviewed the proposed Potable Water <br />Element, Water Supply Facilities Work Plan, and 5 Year Capital Improvements Schedule 2007 — 2012 and <br />issued its Objections, Recommendations and Comments (ORC) Report on October 16, 2007; and <br />WHEREAS, the Department of Community Affairs provided comments to the 5 Year Capital <br />Improvements Schedule 2007 — 2012 and no comments for the Potable Water Element or the Water Supply <br />Facilities Work Plan; and <br />
