ORDINANCE 15 -1419 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA; <br />AMENDING PART III, ARTICLE XIV OF THE CASSELBERRY CODE <br />OF ORDINANCES ENTITLED "TREE PROTECTION" BY REPEALING <br />ARTICLE XIV IN ITS ENTIRETY AND ESTABLISHING ARTICLE XIV <br />TO INCLUDE SECTION 3- 14.1., "APPLICABILITY," SECTION 3- 14.2., <br />"PURPOSE AND INTENT," SECTION 3- 14.3., "PERMIT REQUIRED <br />FOR REMOVAL," SECTION 3- 14.4., "ESTABLISHMENT OF CITY <br />TREE ADVISORY COMMITTEE," SECTION 3- 14.5., "TREE <br />PROTECTION AND SURVIVAL," SECTION 3- 14.6., "SPECIMEN <br />TREES," SECTION 3- 14.7., "TREE REPLACEMENT REQUIREMENTS," <br />AND SECTION 3- 14.8., "VIOLATIONS, WAIVERS AND APPEALS;" <br />AMENDING PART II, ARTICLE V, SECTION 2 -210., "SCHEDULE OF <br />VIOLATIONS," TO CHANGE THE REFERENCE FOR REMOVAL OF <br />TREES WITHOUT PERMIT; AMENDING ARTICLE XXI, SECTION 5- <br />21.2., "DEFINITION OF TERMS," TO ADD ASSOCIATED <br />DEFINITIONS; PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry Planning and Zoning Commission requested a <br />review of the Landscaping and Tree Protection sections of the Unified Land Development <br />Regulations (ULDR) at their regularly scheduled meeting on March 13, 2013; and <br />WHEREAS, the City of Casselberry values the importance of trees to help beautify and <br />improve aesthetics of the City, and to benefit wildlife and the environment; and <br />WHEREAS, the City wishes to create a clear, consistent and fair code which aims to <br />meet its goals of tree protection and provide feasible tree replacement options that ensure <br />maintenance of an appropriate tree canopy, , and efficient staff involvement; and <br />WHEREAS, the City wishes to protect trees within the City by requiring best practice <br />methods for planting, maintenance and care; and <br />WHEREAS, the measurement of trees will be changed from diameter at breast height to <br />caliper to be in line with industry standard; and <br />WHEREAS, the City wishes to exempt duplex and single family homes from tree <br />replacement; and <br />WHEREAS, the City wishes to protect specimen trees where possible within <br />development sites; and; <br />WHEREAS, a new replacement standard has been created which sets standards based <br />upon the type of development in order to meet the goals and objectives for trees within the City; <br />and <br />
