ORDINANCE 15 -1421 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO ADOPT THE FIVE YEAR CAPITAL IMPROVEMENT SCHEDULE 2015 — 2019 AS PART OF THE CITY'S COMPREHENSIVE PLAN IN ACCORDANCE WITH MANDATES SET FORTH IN CHAPTER 163, FLORIDA STATUTES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the Florida Legislature intends that local planning be a continuous and on- going process; and WHEREAS, the Growth Management legislation, F.S. 163.3177(3), requires an annual update to the Five Year Capital Improvement Schedule (CIS) in the Capital Improvements Element (CIE); and WHEREAS, the Five Year Capital Improvement Schedule 2015 -2019 includes both the "Casselberry Five Year Capital Projects and Equipment Purchases" and the Seminole County School Board's "Five Year Capital Improvement Plan ". NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission does hereby adopt the City of Casselberry's 2015 — 2019 "Casselberry Five Year Capital Projects and Equipment Purchases" into the City of Casselberry's Comprehensive Plan as part of its Five Year Capital Improvement Schedule, attached hereto as Exhibit "A ", and incorporated by reference. SECTION II. The City Commission does hereby adopt the Seminole County School Board's 2014/15 — 2018/19, "Five Year Capital Improvement Plan" into the City of Casselberry's Comprehensive Plan as part of its Five Year Capital Improvement Schedule, attached hereto as Exhibit "B ", and incorporated by reference. SECTION III. CONFLICTS. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. SECTION IV. SEVERABILITY. If any Section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. SECTION V. EFFECTIVE DATE. The effective date of this Plan Amendment shall be the date this Ordinance is adopted. FIRST READING this �` day of �� , A.D. 2015.
