ORDINANCE 15 -1429 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY CODE, PART III, UNIFIED LAND <br />DEVELOPME NT REGULATIONS, TABLE 2 -5.3, LAND USE BY <br />DISTRICT, TO ALLOW SALES OF ALCOHOLIC BEVERAGES <br />FOR ON -SITE CONSUMPTION AS A CONDITIONAL USE <br />WITHIN THE CS (SERVICE COMMERCIAL) ZONING <br />DISTRICT; AMENDING TABLE 2 -5.4, SIZE AND DIMENSION <br />REGULATIONS, TO SPECIFY 13 DWELLING UNITS PER ACRE <br />FOR OR (OFFICE RESIDENTIAL) AND CL (LIMITED <br />COMMERCIAL) ZONING DISTRICTS; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY AND <br />EFFECTIVE DATE. <br />WHEREAS, the City Commission amended the City's Future Land Use Element on <br />June 10, 2013, with the goal of providing a quality living environment for all residents by <br />ensuring a sound economic future through proper development and redevelopment, and to <br />protect and preserve the quality of the environment and natural resources; and <br />WHEREAS, consistent with this goal, the City will establish land use categories and <br />policies which will be consistent with future land use considering the topography, soil condition, <br />availability of facilities and services, and contrasting land use; and <br />WHEREAS, under Policy 1.8 of the Future Land Use Element, high density residential <br />uses may be permitted within certain commercial land use categories (zoning districts), provided <br />they are compatible with surrounding uses and do not create demands upon the City's <br />infrastructure that will exceed the City's ability to meet its adopted level of service standards; <br />and <br />WHEREAS, the City Commission finds it necessary to amend Table 2 -5.3 to allow for <br />"sales of alcoholic beverages for on -site consumption" as a conditional use for CS zoning <br />districts so as to be consistent with the City's Future Land Use Plan; and <br />WHEREAS, the City has four commercial zoning districts that include office /residential <br />(OR), limited commercial (CL), general commercial (CG) and service commercial (CS); and <br />WHEREAS, the City's Comprehensive Plan provides for residential uses in the <br />commercial zoning district and the Unified Land Development Regulations allows residential <br />use as a permitted use in the OR district and as a conditional use in the CL district, but residential <br />is not allowed as either a permitted or conditional in CG districts; and <br />WHEREAS, the Table 2 -5.4 does not specify the number of units allowed per acre for <br />the OR and CL zoning districts; and <br />WHEREAS, the City's Planning and Zoning Board sitting as the Land Planning Agency <br />has reviewed this Ordinance and finds it is consistent with the comprehensive plan; and <br />
