RESOLUTION 15 -2805 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AUTHORIZING THE EXTENSION OF THE <br />AGREEMENT WITH WASTE PRO OF FLORIDA, INC. TO PROVIDE <br />COMMERCIAL WASTE CONTAINERS, HAULING AND DISPOSAL FOR <br />NINE (9) CITY OF CASSELBERRY FACILITIES AND RELATED ANNUAL <br />RATE ADJUSTMENT BASED ON THE 2015 CONSUMER PRICE INDEX (CPI); <br />PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, via Resolution 11 -2327, the City of Casselbeny entered into an agreement with <br />Waste Pro of Florida, Inc. for commercial waste services that provides containers, hauling and disposal <br />to the nine City -owned facilities; and <br />WHEREAS, via Resolution 13 -2454, the City of Casselberry extended the agreement for an <br />additional one (1) year and approved the 2012 CPI rate adjustment of 2.2 %; and <br />WHEREAS, via Resolution 13 -2555, the City of Casselbeny extended the agreement for an <br />additional one (1) year and approved the 2013 CPI rate adjustment of 1.5 %; and <br />WHEREAS, via Resolution 15 -2697, the City of Casselbeny extended the agreement for an <br />additional one (1) year and approved the 2014 CPI rate adjustment of 1.7 %; and <br />WHEREAS, the City wishes to extend the agreement for the final one (1) year and the <br />Procurement Administrator has reviewed the 2015 CPI data submitted of 0.17% and recommends a rate <br />adjustment accordingly. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the one (1) year <br />extension of the said Agreement and an annual CPI rate adjustment of 0.17 %. <br />SECTION II. Conflicts. All Resolutions or parts of Resolution in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or <br />effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon its <br />passage and adoption. <br />
