RESOLUTION 15 -2811 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF SUPPLEMENTAL AGREEMENT NO. 5 TO THE <br />STANDARD CONSULTANT AGREEMENT FOR PROFESSIONAL <br />SERVICES FOR TRANSPORTATION ENGINEERING WITH CDM <br />SMITH, INC. TO PROVIDE CONSTRUCTION MATERIALS TESTING <br />SERVICES RELATED TO THE LAKE CONCORD PARK PROJECT; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE. <br />WHEREAS, the City has entered into a Construction Manager at Risk contractual <br />relationship with Wharton - Smith, Inc. to construct the infrastructure improvements associated with <br />the proposed Lake Concord Park development for the residential and commercial sites, including <br />the public amenity areas; and <br />WHEREAS, Universal Engineering Sciences (a professional geotechnical engineering <br />firm) prepared a geotechnical report clearly identifying unsuitable materials (muck) in the project <br />areas (including the proposed public amenity areas for pond sites, retaining walls and underground <br />utilities) requiring remediation; and <br />WHEREAS, successful development of the Lake Concord Park Project requires <br />construction materials testing services by a professional geotechnical engineering to provide <br />oversight to ensure the removal of unsuitable materials (muck) for the proposed public amenity <br />areas; and <br />WHEREAS, on November 13, 2012, the City entered into a Standard Consultant <br />Agreement with CDM Smith, Inc. (CDM Smith) which currently remains in effect for professional <br />services for transportation engineering; and <br />WHEREAS, CDM Smith has provided a proposal in the amount of $23,770 to provide said <br />construction materials testing services for this project, which has been incorporated into <br />Supplemental Agreement No. 5; and <br />WHEREAS, Public Works staff has reviewed the proposed Supplemental Agreement No. <br />5 and finds it sufficient to meet the needs of the City . <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselbeny hereby approves <br />Supplemental Agreement No. 5 to the Standard Consultant Agreement for Professional Services for <br />Transportation Engineering with CDM Smith, Inc. to provide construction materials testing <br />
