RESOLUTION 15 -2781 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF AMENDMENT #1 TO SUPPLEMENTAL AGREEMENT NO. 3 WITH REISS ENGINEERING, INC. FOR ADDITIONAL POST - DESIGN SERVICES FOR THE ELM DRIVE LIFT STATION RELOCATION; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, on January 13, 2014 via Resolution 14 -2560, the City Commission approved Supplemental Agreement No. 3 to the Standard Consultant Agreement with Reiss Engineering, Inc. (Reiss) to provide design services for the relocation of the Elm Drive lift station; and WHEREAS, the existing lift station was located at the back of a private residential property under power lines which provides an inconvenient and unsafe working condition; and WHEREAS, the lift station was relocated to the front of the private residential property; WHEREAS, construction of the wet well on this project was difficult and required additional inspection and coordination with the contractor; and WHEREAS, Public Works staff negotiated a proposal from Reiss for an amount not to exceed $10,000 to perform additional post- design services for the Elm Drive Lift Station Relocation project; and WHEREAS, Public Works staff has reviewed Amendment #1 to Supplemental Agreement No. 3 with Reiss and finds it favorable to the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves Amendment #1 to Supplemental Agreement No. 3 with Reiss Engineering, Inc. for additional post- design services for an amount not to exceed $10,000, and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
