RESOLUTION 15 -2791 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, <br />DETERMINING THE NECESSITY AND PUBLIC PURPOSE FOR THE <br />FEE SIMPLE ACQUISITION OF A DITCH AND FORMER DRIVEWAY <br />PROPERTY IN THE CITY OF CASSELBERRY, LOCATED OFF <br />SEMINOLA BOULEVARD IN THE AREA PLATTED AS BAY TREE <br />SHORES, BY EMINENT DOMAIN OR THROUGH NEGOTIATION, AND <br />AUTHORIZING THE CITY ATTORNEY TO INITIATE EMINENT <br />DOMAIN PROCEEDINGS TO ACQUIRE THE NECESSARY <br />PROPERTY; PROVIDING FOR SEVERABILITY AND AN IMMEDIATE <br />EFFECTIVE DATE. <br />WHEREAS, pursuant to its Home Rule Powers, and its powers set forth in chapters 73 <br />and 74, Florida Statutes, and sections 166.401 and 166.411, Florida Statutes, the City of <br />Casselberry intends to acquire by eminent domain the property depicted and legally described in <br />Exhibit "A" for the public purpose of park and assemblage uses, and related ancillary purposes; <br />and <br />WHEREAS, the City has surveyed and located the area of acquisition and the City <br />Commission finds that the whole of the property depicted and legally described in Exhibit "A ", <br />in the area platted as Bay Tree Shores off Seminola Boulevard, is necessary to acquire to serve <br />the stated public purposes. <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />Section 1. The above recitals are hereby adopted as findings of fact and conclusions <br />of law as if fully set forth in this operative part of this Resolution. <br />Section 2. Public Purpose Established. Fee simple acquisition of the property <br />described in Exhibit "A" for use as a park, assemblage, and related purposes is a public purpose. <br />Section 3. Necessity Established. Fee simple acquisition of the property described in <br />Exhibit "A" is necessary to accomplish the public purposes set forth herein. <br />Section 4. Authorization to Initiate Acquisition. The City Commission authorizes <br />City officers, agents, employees, contractors and attorneys to do all acts and things required of <br />them by this Resolution, or desirable or consistent with the requirements of this Resolution, for <br />the full, punctual, efficient, and complete performance of all the terms contained herein and <br />authorized by law and shall deliver any and all papers and instruments, and carry out all acts and <br />things necessary or proper for carrying out the transactions contemplated herein. <br />1 <br />
