subject to the application has vested status and should be considered for <br />an exception to the moratorium. Within seven (7) calendar days after <br />making a final determination of vested rights status, the City Commission <br />must provide the applicant with written notification of the determination of <br />vested rights status. <br />e) At the hearing, the applicant must present all evidence in support of the <br />application. The technical rules of evidence in judicial proceedings will <br />not be applicable, but all testimony will be given under oath. <br />f) Decisions made by the City Commission under this Ordinance may be <br />appealed by the real property owner in the Circuit Court in and for <br />Seminole County, Florida. <br />Section 6. Severability. If any section, subsection, sentence, clause, <br />phrase or portion of this Ordinance, or application, is held or declared to be <br />unconstitutional, inoperative or void, such holding of invalidity will not affect the <br />remaining portions of this Ordinance and will be construed to have been the <br />legislative intent to pass this Ordinance without such unconstitutional, invalid or <br />inoperative parts, and the remainder of this Ordinance, after excluding such part or <br />parts, will be deemed valid as though this ordinance has been adopted without <br />such unconstitutional, invalid or inoperative part and if this Ordinance or any <br />provision thereof, is held inapplicable to any person, group of persons, property, <br />kind of property, circumstances, or set of circumstances, such holding will not affect <br />the application to any other person, property or circumstances. <br />
