WHEREAS, low -THC cannabis dispensaries would likely cause some, if <br />not all, of the adverse impacts other communities have experienced due to <br />medical marijuana dispensaries; and <br />WHEREAS, the Florida Department of Health, Office of Compassionate <br />Use, published Proposed Rule 64 -4.001 on February 6, 2015, defining certain <br />terms such as Dispensing Organization, Dispensing Organization <br />Facilities, Cultivating Facility, Processing Facility, and Dispensing Facility; and <br />WHEREAS, the City Commission has determined that it is advisable to <br />further study the adverse impacts of low -THC cannabis dispensing organization <br />facilities; and <br />WHEREAS, the City regulates the use of land through its Comprehensive <br />Plan and Land Development Regulations; and <br />WHEREAS, the City does not currently have definitions or regulations <br />within its Land Development Regulations for Dispensing Organization Facilities <br />including facilities for the cultivation, processing, and dispensing of low -THC <br />cannabis; and <br />WHEREAS, the City Commission desires for its staff to have sufficient <br />time to review and make recommendations for the enactment of regulations <br />governing said activities; and <br />WHEREAS, the City believes that by establishing a moratorium for 180 <br />days on the issuance of business tax receipts or land use approvals for <br />Dispensing Organization Facilities, the City will have the opportunity to research <br />and study various regulatory options; and <br />WHEREAS, the City Commission finds it is in the best interest of the <br />citizens of the City to minimize and control the adverse effects of activities <br />relating to Dispensing Organization Facilities, thereby protecting the health, <br />safety, and welfare of its citizenry; protecting the citizens from increased crime; <br />preserving the quality of life and preserving property values, by adopting <br />appropriate regulations; and <br />WHEREAS, the City has authority in accordance with the Florida <br />Constitution, Chapter 163 and 166 of the Florida Statutes to enact regulations in <br />the interest of the public health, safety and welfare of its citizens; and <br />WHEREAS, On May 13, 2015, the Planning and Zoning Commission <br />reviewed and recommended approval of Ordinance 15 -1426. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION <br />OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />3 <br />
