ORDINANCE 15 -1426 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />ESTABLISHING A TEMPORARY MORATORIUM OF ONE <br />HUNDRED AND EIGHTY DAYS PROHIBITING THE OPERATION <br />OF ANY LOW -THC CANNABIS DISPENSING ORGANIZATION <br />FACILITIES WITHIN THE CITY OF CASSELBERRY, AND ON THE <br />ISSUANCE OF BUSINESS TAX RECEIPTS, DEVELOPMENT <br />ORDERS OR PERMITS FOR DISPENSING ORGANIZATION <br />FACILITIES WITHIN THE CITY LIMITS IN ORDER TO PROVIDE <br />THE CITY AN OPPORTUNITY TO REVIEW AND ENACT <br />REGULATIONS GOVERNING SAID ACTIVITIES; ESTABLISHING <br />A PURPOSE AND INTENT; MAKING CERTAIN FINDINGS; <br />PROVIDING FOR AN ADMINISTRATIVE REMEDY FOR <br />ASSERTIONS OF VESTED RIGHTS AND PROCESSES AND <br />PROCEDURES RELATING TO SUCH ASSERTIONS; PROVIDING <br />DEFINITIONS; PROVIDING FOR SEVERABILITY; PROVIDING <br />FOR NON - CODIFICATION AND PROVIDING FOR EFFECTIVE <br />DATE. <br />WHEREAS, the City is granted the authority, under Section 2(b), Article <br />VIII, of the State Constitution, to exercise any power for municipal purposes, <br />unless prohibited by law; and <br />WHEREAS, Section 381.986, Florida Statutes, also known as the <br />"Compassionate Medical Cannabis Act of 2014" (the "Act "), was signed into law <br />and required the Department of Health to establish a compassionate use registry, <br />select five (5) dispensing organizations, monitor physician registration and <br />ordering of low -THC cannabis, and adopt rules for implementation of the Act on <br />or before January 1, 2015; and <br />WHEREAS, the Act legalized low - tetrahydrocannabinol (THC) cannabis, <br />such as the strain Charlotte's Web, for medical patients suffering from cancer or <br />"a physical medical condition that chronically produces symptoms of seizures," <br />such as epilepsy, "or severe and persistent muscle spasms "; and <br />WHEREAS, the Act authorizes a limited number of large nurseries to <br />cultivate, process and dispense low -THC cannabis and operate as "dispensing <br />organizations "; and <br />WHEREAS, the Act would allow one of the limited number of large <br />nurseries to open up low -THC cannabis dispensing establishments throughout <br />the state, including the Central Florida region; and <br />
