RESOLUTION 15 -2792 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA ACCEPTING A LAND <br />DONATION BY ELIAS MANGUAL AND RAFAEL CLAUDIO <br />AND AUTHORIZING EXECUTION OF A LAND DONATION <br />AGREEMENT FOR PARCEL ID #09- 21- 30- 5BP -OBBO -0120; <br />PROVIDING FOR CONFLICTS, SEVERABILITY AND <br />EFFECTIVE DATE. <br />WHEREAS, a City code enforcement lien exists on a parcel of land located on Park <br />Drive, Parcel ID #09- 21- 30- 513P -013130 -0120, and a fine continues to accrue at $25.00 per day <br />due to the need to maintain a fence on the property; and <br />WHEREAS, the owners of the property have requested to donate that property to the <br />City in lieu of paying the fine; and <br />WHEREAS, Ardaman & Associates conducted a Phase I Environmental Study on the <br />property and determined that there is no contamination or endangered species on the property; <br />and <br />WHEREAS, the City Attorney created, reviewed and approved the Land Donation <br />Agreement executed by the property owners; and <br />WHEREAS, the property has value to the City as an expansion to an existing stormwater <br />retention area. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the Land <br />Donation Agreement (attached as Exhibit A) and authorizes the Mayor to execute said document <br />on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of <br />the provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any section, subsection, sentence, clause, phrase or <br />portion of this Resolution is for any reason held invalid or unconstitutional in any court of <br />competent jurisdiction, such portion shall be deemed a separate, distinct and independent <br />provision and such holding shall not affect the validity of the remaining portion hereto. <br />
