RESOLUTION 15 -2788 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF GUARANTEED MAXIMUM PRICE TO THE <br />CONSTRUCTION MANAGER AT RISK SERVICE AGREEMENT WITH <br />WHARTON SMITH, INC. FOR CONSTRUCTION OF THE LAKE <br />CONCORD PARK AND TRIPLET LAKE DRIVE SIGNATURE STREET <br />PROJECTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND <br />EFFECTIVE DATE. <br />WHEREAS, on March 9, 2015, the City Commission approved the Construction <br />Manager at Risk Service Agreement (CMRSA) with Wharton Smith, Inc. for the Lake Concord <br />Park and Triplet Lake Drive Signature Street projects; and <br />WHEREAS, the CMRSA, at the completion of plans for the Lake Concord Park and <br />Triplet Lake Drive Signature Street projects, requires Wharton Smith to provide a guaranteed <br />maximum price for construction the improvements associated with each project; and <br />WHEREAS, Wharton Smith has submitted a guaranteed maximum price proposal to <br />construct the required Lake Concord Park project improvement in the amount of $7,324,162; and <br />WHEREAS, Wharton Smith has submitted a guaranteed maximum price proposal to <br />construct the required Triplet Lake Drive Signature Street project improvement in the amount of <br />$3,092,425; and <br />WHEREAS, the City Manager has reviewed the agreement with Wharton Smith, Inc. <br />and finds it favorable to the City. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves the <br />agreement with Wharton Smith, Inc. for an amount not to exceed $7,324,162 for the Lake <br />Concord Park project and $3,092,425 for the Triplet Lake Drive Signature Street project, and <br />authorizes the Mayor to execute said document on behalf of the City. <br />SECTION H. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
