RESOLUTION 13 -2557 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE EXECUTION OF AMENDMENT #3 WITH WHARTON- SMITH, INC. FOR TECHNICAL SERVICES FOR THE DESIGN AND PRE- CONSTRUCTION SERVICES RELATED TO THE EMERGENCY GENERATORS AT THE NORTH AND HOWELL PARK WATER TREATMENT PLANTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City owns, operates and maintains three water treatment plants that require continuous operation; and WHEREAS, emergency generators are located at each water treatment plant to provide electricity during power outages to continue the provision of potable water to the City's customers; and WHEREAS, the emergency generators at the North and Howell Park Water Treatment plants are nearing the end of their service life and require updating; and WHEREAS, via Resolution 12 -2344, the City entered into an agreement with Wharton - Smith, Inc. to provide Construction Management at Risk for Projects under $2M; and WHEREAS, Wharton- Smith, Inc. has submitted Amendment #3 to said agreement to provide for the design of the emergency generator upgrades at the North and Howell Park water treatment plants and provide pre - construction services for an amount not to exceed $17,375; and WHEREAS, Public Works staff has reviewed Amendment #3 to the agreement with Wharton- Smith, Inc. and finds it favorable to meet the needs of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves Amendment #3 to the agreement with Wharton- Smith, Inc. to provide design and pre - construction services related to emergency generator upgrades associated with the North and Howell Park Water Treatment Plants for an amount not to exceed $17,375 and authorizes the Mayor to execute said document on behalf of the City. SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed. SECTION III. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution.
