RESOLUTION 13 -2555 "A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE EXTENSION OF THE AGREEMENT WITH WASTE PRO OF FLORIDA, INC. TO PROVIDE COMMERCIAL WASTE CONTAINERS, HAULING AND DISPOSAL FOR NINE (9) CITY OF CASSELBERRY FACILITIES AND RELATED ANNUAL RATE ADJUSTMENT BASED ON THE 2013 CONSUMER PRICE INDEX (CPI) ; PROVIDNG FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." WHEREAS, via Resolution 11 -2327, the City of Casselberry entered into an agreement with Waste Pro of Florida, Inc. for commercial waste services that provides containers, hauling and disposal to the nine City -owned facilities; and WHEREAS, via Resolution 13 -2454, the City of Casselberry extended the agreement for an additional one (1) year and approved the 2012 CPI rate adjustment of 2.2% ; and WHEREAS, the City wishes to extend the agreement for a second one (1) year and the Procurement Administrator has reviewed the 2013 CPI data submitted and recommends a rate adjustment of 1.5% accordingly; and WHEREAS, the monthly rate for commercial containers, hauling and disposal from City facilities will be increased from $2374.98 to $2427.03 effective January 1, 2014 through December 31, 2014. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. The City Commission of the City of Casselberry hereby approves the one (1) extension of the said Agreement and an annual CPI rate adjustment of 1.5 %. SECTION H. Conflicts, All Resolutions or parts of Resolution in conflict with any of the provisions of this Resolution are hereby repealed. SECTION M. Severability. If any Section or portion of a Section of this Resolution proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Resolution. SECTION IV. Effective Date. This Resolution shall become effective immediately upon its passage and adoption.
