Planning & Zoning Commission/ <br />Local Planning Agency <br />April 8, 2015 <br />Page 2 <br />Fifth Item of Business: SP 15 -02: Polio Tropical Plat. Request to subdivide a parcel located at 1401 State Road 436 to <br />create a separate parcel from the existing shopping center plaza parcel. <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated April 8, 2015, and a <br />PowerPoint presentation to the City of Casselberry Planning and Zoning Commission. Ms. Regan said if the Planning and <br />Zoning Commission chooses to recommend approval to the City Commission for SP 15 -02 for the Casselberry Commons final <br />plat at 1401 State Road 436, Casselberry, Florida, the approval should be based upon the plat dated March 6, 2015, the <br />findings of fact and conclusions of the staff report dated April 8, 2015, and the following conditions: <br />1. The City Surveyor shall execute the signature block prior to recording of the final plat. <br />2. The Joiner and Consent agreement needs to be signed and recorded at the same time the plat is recorded. <br />3. The applicant, per F.S. Chapter 177, is responsible for the City Surveyor and City Attorney fees. The applicant <br />is also responsible for Seminole County recording fees. <br />4. After City Commission approval, the applicant shall provide one (1) mylar of the plat executed by the owner and <br />surveyor and any other information requested as part of compliance to F.S. Chapter 177, to be recorded by the <br />City. <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br />request. No one came forward. <br />Mr. Henson asked the applicant to come forward. The applicant was not present at the meeting. <br />Mr. Henson asked for a motion to address SP 15 -02. Mr. Bryan made a motion that the Planning and Zoning <br />Commission recommend approval to the City Commission for SP 15 -02 for the Casselberry Commons final plat at 1401 State <br />Road 436, Casselberry, Florida, the approval is based upon the plat dated March 6, 2015, the findings of fact and conclusions <br />of the staff report dated April 8, 2015, and the four conditions listed in the staff report. Mr. Van Meter seconded the motion. <br />The motion passed unanimously by voice vote. <br />Sixth Item of Business: BA 15 -01: 368 Capron Ash Loop /R. Olsen & M. Diaz. Variance request to allow a 6 foot high <br />fence to encroach 8 feet into a front yard in the PMX -L zoning district. <br />Ms. Marie Regan, Planner II, reviewed the information provided in her memorandum dated April 8, 2015, and a <br />PowerPoint Presentation to the City of Casselberry Planning and Zoning Commission (a copy of the PowerPoint presentation <br />is attached and made a part of the minutes). She said the variance application meets all six (6) criteria for granting the <br />variance; therefore, staff supports the variance request as presented. Ms. Regan said if the Planning and Zoning Commission <br />chooses to grant a six (6) foot fence variance, BA 15 -01, for the property located at 368 Capron Ash Loop, the motion should <br />be based upon the Planning and Zoning Commission's findings of fact and conclusions, the staff report dated April 8, 2015, <br />the property survey attached as Exhibit B, and the following conditions: <br />
