Planning & Zoning Commission/ <br />Local Planning Agency <br />January 14, 2015 <br />Page 2 <br />Planning and Zoning Commission approved a conditional use for Bowigens Beer Company in August 2014. He said that the <br />interior renovations have taken longer than expected and they are requesting an extension to their conditional use approval. <br />Mr. Sorensen said that the approval would be based on the ten conditions of approval outlined in the staff report. The ten <br />conditions of approval are: <br />1. Expansion of the tenant space or of the consumption area shall require additional conditional use review. <br />2. At least 51 % of the interior space shall be for retail sales and /or consumption of alcohol. <br />3. All consumption and sales shall be in -doors and in the outside area as shown in Exhibit B after the outside area <br />has been approved (and perhaps amended) by the Development Review Committee. The outside patio area <br />shall be defined by a fence and gate barrier and shall be decorated with potted plants and /or flowers in front of <br />the fence. <br />4. The conditional use shall be limited to the location of 1014 SR 436 and adjacent outdoor patio within the barrier. <br />5. The hours of alcohol sales shall comply with the hours set forth in Section 10.2 of the City of Casselberry's Code <br />as long as the use is in conjunction with a restaurant. <br />6. The business shall remain in complete compliance with all City, County and State requirements. <br />7. There shall be no outside display or storage of goods, materials, or vehicles. <br />8. The conditional use shall commence within 120 days starting December 11, 2014. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. <br />He said condition number 8 has been changed to reflect the extension date. In response to the Commission's <br />question regarding the length of the extension, Mr. Sorensen said the applicant feels the 120 day extension is more than <br />sufficient. <br />Mr. Hale stated that the applicant was not present at the meeting. <br />Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. <br />No one came forward. <br />Mr. Hale asked for a motion to address CU 15 -02. Mr. Henson made a motion that the Planning and Zoning <br />Commission approve the extension for Bowigens Beer Company (CU 15 -02) paying particular attention to the ten conditions <br />of approval outlined in the staff report and the change to the date in condition number 8 to 120 days from December 11, 2014. <br />Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: LPA 14 -07 — Assisted Living Facilities Criteria. ULDR text amendment to add "Assisted <br />Living Facilities" use with specifications. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated January 14, 2015, and <br />a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy of the PowerPoint <br />Presentation is attached and made a part of the minutes). Mr. Sorensen said this item is scheduled for the February 9, 2015 <br />
