Planning & Zoning Commission/ <br />Local Planning Agency <br />August 13, 2014 <br />Page 3 <br />Mr. Meadows asked for a motion to address CU 14 -13. Mr. Henson made a motion to approve CU 14 -13 <br />based on staffs recommendations with the deletion of the word "services" on condition No. 7. Mr. Bryan seconded <br />the motion. The motion passed unanimously by voice vote. <br />Sixth Item of Business: SPR 14 -08 —1239 State Road 436 - Walmart Liquor Box: Major site plan review for a <br />3,920 square foot addition to the existing Walmart for a liquor retail store with associated site work. <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated August 13, 2014 <br />to the City of Casselberry Planning and Zoning Commission. Mr. Sorensen said staff recommends approval of SPR <br />14 -08, site plan for Walmart Liquor Box at 1239 State Road 436, based on the information provided in the staff report <br />dated August 13, 2014, including the site plan and landscape plan dated May 19, 2014, the building elevations, and <br />the following conditions: <br />1. All Public Works issues must be addressed prior to issuance of a site construction permit. <br />2. All landscaping must remain in good condition and be kept free of weeds and overgrowth. <br />3. Any required Tree Bank payment must be made prior to issuance of a Certificate of Occupancy. <br />4. All conditions must be fully executed or the site plan becomes null and void. <br />5. The site plan is valid for one year. Failure to obtain a building permit within one year will result in the <br />expiration of the site plan approval. <br />Mr. Meadows asked the applicant to come forward. Mr. Matt Femal, Kimley -Horn & Associates, 655 North <br />Franklin Avenue, Tampa, Florida came forward. A brief discussion ensued regarding the hours of operation for the <br />liquor store. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Sorensen stated that Section 10 -2 of the City of Casselberry Code limits the sale and on -site <br />consumption of alcoholic beverages to 7 a.m. to 2 a.m. seven days a week. <br />Mr. Meadows asked for a motion to address SPR 14 -08. Mr. Bryan made a motion that the Planning and <br />Zoning Commission approve SPR 14 -08, site plan for Walmart Liquor Box at 1239 State Road 436, based on the <br />information provided in the staff report dated August 13, 2014, including the site plan and landscape plan dated May <br />19, 2014, the building elevations„ and the five conditions outlined in the staff report. Mr. Henson seconded the <br />motion. The motion passed unanimously by voice vote. <br />
