The City requested the property owner be given 14 days to come into compliance or a $25.00 per day fine <br />would begin to accrue. <br />Richard Taylor, 1460 E. Altamonte Dr. stated he had been trying to get a permit and get this situation <br />compliant. Mr. Taylor was told he could not do it and had to get a contactor and has been taking steps for <br />90 days to try to get this resolved. Mr. Taylor stated he just needs more time, he's not sure if he can do <br />this in 14 days. <br />Mr. Hernandez advised that he understands the process and is willing to extend to 30 days. <br />FINDING OF FACT: The Special Magistrate made a finding that it's undisputed that the construction <br />actually occurred and no permit was obtained. The property is in violation and to come into compliance <br />by 1 pm, 8/10/2014, if no compliance a fine of $25.00 per day will start to accumulate, so ordered. <br />NEW CASES <br />Swimming pool standards, ULDR Section 3 -10 <br />• CE -14 -00499 370 Lilac Rd <br />Officer Hernandez read the above case into record and gave testimony. This property has a lis pendens, <br />the owner and attorney have need notified about the pool condition. This violation threatens the health, <br />safety and welfare of the community, therefor the City requests the property owner to be given 14 days <br />to come into compliance or a $50.00 per day fine would begin to accrue. <br />The Special Magistrate asked if there was anyone present to speak to this case. There was no one present <br />for this case. <br />FINDING OF FACT: The Special Magistrate made a finding that the condition of the pool presents a <br />health and safety hazard. It is adjudicated that the property is in violation and the property come into <br />compliance by 1pm, 7/24/2014, or a fine of $50.00 per day will begin to accrue, so ordered. <br />Swimming pool standards, ULDR Section 3 -10 <br />• CE -14 -00570 1291 Avalon Blvd <br />Roof maintenance, ULDR Section 3 -10.3 <br />• CE -14 -00571 1291 Avalon Blvd <br />Fence maintenance, ULDR Section 3 -10.3 (B) <br />• CE -14 -00580 1291 Avalon Blvd <br />Officer Hernandez read the above case into record and gave testimony for the above cases. Case 14- <br />00570 was a citizen complaint about the pool, the home is vacant and the property owner has been <br />notified about the pool condition. Case 14- 00571, is for roof damage, the photo shows tarps on the roof, <br />this was an anonymous complaint. Case 14- 00580, is for fence maintenance, after numerous citizen <br />complaints. The City requests 14 days to come into compliance or a $25.00 per day fine will begin to <br />accrue, for each violation. Mr. Hernandez stated that for the pool violation the fine would be $50.00 per <br />day. <br />Randy Bach, council for Nationstar advised that they still have not taken title to the property. They are <br />scheduled for a non jury trial on 7/14/2014. Mr. Bach asked for the maximum extension the City would <br />allow. <br />5 Page <br />
