WHEREAS, the City Commission finds that the closing, vacating and abandoning <br />of a portion of said right -of -way will not present a detriment to either the City of <br />Casselberry, Florida, or the public, and is in the public interest. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF TH-2 <br />CITY OF - - -. <br />SECTION 1. The City Commission of the City of Casselberry hereby approves the <br />closing, vacating and abandonment of a portion of Triplet Lake Drive and Municipal Way <br />right -of -way as described in Exhibit "A" in the City of Casselberry, and the City shall retain <br />a temporary public access easement over the abandoned right -of -way described in <br />Exhibit "A" until such time as the pad for Building B (as shown on Exhibit "B ") is under <br />construction. As of the effective date, the City Commission of the City of Casselberry, <br />Florida, renounces any rights in and to the afore - described right -of -way, attached as <br />Exhibit "A ", except for the temporary easement, and authorizes the Mayor to sign this <br />Resolution. <br />SECTION 2. SEVERABILITY. If any section or portion of a section of this <br />Resolution proves to be invalid, unlawful or unconstitutional, it shall not be held to impair <br />the validity, force or effect of any other section or part of this Resolution. <br />SECTION 3. CONFLICTS. All Resolutions or parts of Resolutions in conflict <br />herewith be and the same are hereby revoked. <br />SECTION 4. EFFECTIVE DATE. This Resolution shall become effective <br />simultaneously with and upon the City Commission's approval of the plat for Lake <br />Concord Park Unit 1, a Replat. <br />APPROVED AND ADOPTED this day of . »�� 2015. <br />ATTEST: <br />Donna G.
