RESOLUTION 15 -2775 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING AND GRANTING A TEMPORARY EASEMENT TO DUKE ENERGY OVER LOTS 1, 2,3 AND 4 OF THE CASSELBERRY MUNICIPAL CENTER AS RECORDED IN PLAT BOOK 15, PAGE 28 OF THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the City Commission desires to construct the Lake Concord Park project and it associated improvements; and WHEREAS, the Lake Concord Park project includes improvements which include the demolition of existing facilities which will result in the removal of electrical services; and WHEREAS, the timing of demolition and construction of the electrical improvements occur non sequentially requiring temporary easements for continuing service, repairs and maintenance of existing electrical service while new services are being constructed; and WHEREAS, the development of the Lake Concord Park project requires the replatting of the portions of the City's municipal complex and includes the release and vacating of Duke Energy easements encumbering the property; and WHEREAS, Duke Energy requires the Temporary Easement to grant access for supplying, repairing and maintenance of existing facilities including the release of easements for these same facilities that will be replaced by new relocated facilities; and WHEREAS, City staff finds the release of the existing Duke Energy easements as necessary for the replat and the Temporary Easement is a favorable instrument permitting the continuous delivery of electrical services until construction is completed and will not present a detriment to either the City of Casselbeny, Florida, or the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: Section I. The City Commission of the City of Casselberry hereby approves the Temporary Easement (described on Exhibit "A" attached) in the City of Casselbeny to Duke Energy. Section II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the provisions of this Resolution are hereby repealed.
