RESOLUTION 15 -2760 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING RESOLUTION 15 -2744, STREET LIGHTING ASSESSMENT PRELIMINARY RATE RESOLUTION, BY CHANGING THE DATE OF THE PUBLIC HEARING TO MEET STATUTORY REQUIREMENTS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, on June 22, 2015, the City Commission adopted Resolution 15 -2744, Street LightingAssessnaentPreliniinai y Rate Resolution, which provided a brief and general description of the street lighting services, facilities and programs to be provided to Tax Parcels within the Street Lighting Service Area; describes the method of apportioning the Street Lighting Assessed Cost to compute the Street Lighting Assessment for street lighting services, facilities, and programs against Assessed Property; estimated rates of assessment and directs the updating and preparation of the Assessment Roll and provision of the notice required by the Ordinance; and WHEREAS, Resolution 15 -2744 established a public hearing to be held at 4:00 p.m, on August 10, 2015 to receive and consider comments on the Street Lighting Assessments for Fiscal Year 2015 -16; and WHEREAS, the public hearing requires notification by publication and notice by mail 20 days prior to the public hearing; and WHEREAS, an advertising error resulted in the 20 days prior notice not being met; and WHEREAS, the date of the public hearing is changed to 4:00 p.m. on August 24, 2015 in the City Commission Chambers of City Hall, 95 Triplet Lake Road, Casselberry, Florida 32707, at which time the City Commission will receive and consider any comments on the Street Lighting Assessments from the public and affected property owners and consider re- imposition of Street Lighting Assessments for Fiscal Year 2015 -16; and WHEREAS, the notice of public hearing was published no later than August 4, 2015; and WHEREAS, the notice of public hearing was mailed no later than August 4, 2015. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION I. AMENDMENT. This Resolution amends Section 2.03 of Resolution 15- 2744, Street Lighting Assessment Preliminary Rate Resolution, to change the Public Hearing date fi•om August 10, 2015 to August 24, 2015.
