ORDINANCE 14 -1415 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING SECTION 6.03, PUBLIC SAFETY, OF THE CITY CHARTER, TO ALLOW FOR THE TRANSFER OF THE FIRE PROTECTION SERVICES TO SEMINOLE COUNTY; AMENDING THE CHARTER BY ORDINANCE BY UNANIMOUS VOTE, AS PROVIDED FOR IN SECTION 166.031(5), FLORIDA STATUTES; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, the City Commission is set to consider an Interlocal Agreement with Seminole County to provide Fire and Emergency Medical Services within the City; and WHEREAS, the City Commission desires to maintain a high level of competent professional fire and emergency medical services in accordance with sound fiscal policy, and the County desires to render the City a high level of services; and WHEREAS, Fla. Stat. 166.031(5) would allow a municipality, by unanimous vote of the governing body, to transfer municipal departments provided for in the City Charter to that department at the County, although the Attorney General opined that Charter Officers cannot be eliminated by unanimous vote; and WHEREAS, the City Commission, in order to effectuate the Interlocal with the County, desires to amend its Charter to reflect that City Fire and Emergency Medical Services will be provided by the County. NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. AMENDMENTS TO THE CITY CHARTER. Section 6.03, Public Safety, of Article VI, Appointed Officials, of the Charter of the City of Casselberry, Florida, is hereby amended as follows: Sec. 6.03. Public Safety. There is established within the City of Casselberry a Police Department R DepaA ent. The Police departmentfi shall be headed by a Police Chief and there shall also be designated a Fire Chief. The City Manager has the authority to appoint and remove both Chiefs with the approval of a majority of the entire City Commission.
