ORDINANCE 14 -1415 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORIDA, AMENDING SECTION 6.03, PUBLIC SAFETY, <br />OF THE CITY CHARTER, TO ALLOW FOR THE <br />TRANSFER OF THE FIRE PROTECTION SERVICES TO <br />SEMINOLE COUNTY; AMENDING THE CHARTER BY <br />ORDINANCE BY UNANIMOUS VOTE, AS PROVIDED <br />FOR IN SECTION 166.031(5), FLORIDA STATUTES; <br />PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, the City Commission is set to consider an Interlocal Agreement with <br />Seminole County to provide Fire and Emergency Medical Services within the City; and <br />WHEREAS, the City Commission desires to maintain a high level of competent <br />professional fire and emergency medical services in accordance with sound fiscal policy, and the <br />County desires to render the City a high level of services; and <br />WHEREAS, Fla. Stat. 166.031(5) would allow a municipality, by unanimous vote of the <br />governing body, to transfer municipal departments provided for in the City Charter to that <br />department at the County, although the Attorney General opined that Charter Officers cannot be <br />eliminated by unanimous vote; and <br />WHEREAS, the City Commission, in order to effectuate the Interlocal with the County, <br />desires to amend its Charter to reflect that City Fire and Emergency Medical Services will be <br />provided by the County. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION 1. AMENDMENTS TO THE CITY CHARTER. Section 6.03, Public <br />Safety, of Article VI, Appointed Officials, of the Charter of the City of Casselberry, Florida, is <br />hereby amended as follows: <br />Sec. 6.03. Public Safety. <br />There is established within the City of Casselberry a Police Department R <br />DepaA ent. The Police departmentfi shall be headed by a Police Chief and there <br />shall also be designated a Fire Chief. The City Manager has the authority to <br />appoint and remove both Chiefs with the approval of a majority of the entire City <br />Commission. <br />
