and approvals issued after issuance of a building permit and required for the use or <br />occupancy of a Parcel, such as a certificate of occupancy. <br />(hh) "Permitted Exceptions" shall mean those matters of title listed on Exhibit <br />"F" attached hereto. <br />(ii) "Person" shall mean any natural person, firm, partnership, association, <br />corporation, limited liability company, trust, entity, public body, authority, governmental <br />unit or other entity, as applicable. <br />6j) "Preliminary Plans" shall mean the design development documents <br />illustrating the scope, relationship, forms, size, functionality and appearance of the <br />Project Improvements, by means of plans, sections and elevations, typical construction <br />details, site plans and miscellaneous details. The Preliminary Plans are attached hereto <br />as Exhibit "G" and by this reference made a part hereof. <br />(kk) "Project Costs" shall mean all costs of planning, designing, constructing, <br />furnishing and equipping the Project Improvements described in Part 3 of this <br />Agreement. <br />(11) "Project Improvements" shall mean the improvements comprising the site <br />development improvements to be constructed and installed by or on behalf of the City <br />pursuant to Part 3 of this Agreement, in accordance with the Development Plans. <br />"Project Improvements" shall not include any buildings or structures to be constructed <br />on the Property and occupied for either residential or commercial purposes. <br />(mm) "Property Reports" shall mean the geotechnical and environmental <br />assessments, studies and reports listed on Exhibit "H" attached hereto (the <br />"Geotechnical Reports" and the "Environmental Reports", respectively). <br />(nn) "PSP" shall mean the preliminary subdivision plan for the Commercial <br />Parcels, establishing the initial locations and configuration for the Commercial Parcels. <br />(oo) "Public Amenities" shall mean Lake Concord Park and certain amenities <br />located adjacent to the South Village Commercial Parcel, including stormwater ponds, <br />walking paths, pop up retail area and pavilion, and pedestrian connections in the North <br />Village to the boardwalk, all as conceptually shown in Exhibit "I" attached hereto. <br />(pp) "Public Improvements" shall mean the realignment of Triplet Lake Drive, <br />the reconstruction of certain parking spaces in the South Village as conceptually <br />depicted in Exhibit "J" attached hereto, the demolition of a portion of the City's Public <br />Works building, and the construction and installation of the streetscape improvements <br />along S.R. 17-92 along the frontage of the South Village Commercial Parcel, all to be <br />performed by or on behalf of the City in accordance with Part 3 hereof. <br />(qq) "Residential Parcel" shall mean the portion of the City Center Property to <br />be developed and used for multi -family residential purposes and depicted as the <br />"Residential Parcel" on the Master Plan. <br />0215045\157453\1626977v8 <br />
