the Street Lighting Assessed Cost to compute the Street Lighting Assessment for street lighting services, facilities, and programs against Assessed Property; estimated rates of assessment and directs the updating and preparation of the Assessment Roll and provision of the notice required by the Ordinance; and WHEREAS, on July 28, 2014, the City Commission accepted the modifications affecting the Street Lighting Service Area and adjusting rates that were proposed by Bryant Miller Olive and adopted Resolution 14 -2634 (the "Preliminary Rate Resolution "); and WHEREAS, pursuant to the provisions of the Ordinance, the City Commission is required to confirm or repeal the Preliminary Rate Resolution with such amendments as the City Commission deems appropriate after hearing comments and receiving objections from all interested parties; and WHEREAS, the Assessment Roll has heretofore been made available for inspection by the public as required by the Ordinance; and WHEREAS, as required by the Ordinance, notice of a public hearing has been published and mailed to each property owner proposed to be assessed notifying such property owner of the opportunity to be heard concerning the assessments; the proof of publication and an affidavit of mailing are attached hereto as Appendices A and B respectively; and WHEREAS, a public hearing has been duly held on September 8, 2014 and comments and objections of all interested persons have been heard and considered as required by the terms of the Ordinance. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY. This Resolution of the City of Casselberry, Florida (the "City ") is adopted pursuant to City Ordinance No. 09 -1301 (the "Assessment Ordinance "), City Resolution No. 14 -2634 (the "Preliminary Rate Resolution "), Sections 166.021, 166.041 and 197.3632, Florida Statutes, and other applicable provisions of law. SECTION 2. DEFINITIONS. This Resolution is the Final Rate Resolution. Capitalized terms not otherwise defined in this Resolution shall have the meanings defined in the Assessment Ordinance and the Preliminary Rate Resolution. SECTION 3. FINDINGS. It is hereby ascertained, determined and declared that: (A) The findings provided in Section 1.04 of the Preliminary Rate Resolution are hereby ratified, confirmed, and incorporated as if set forth fully herein. 2
