RESOLUTION 14 -2651 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF AMENDMENT #7 TO THE GENERAL CONSTRUCTION <br />MANAGER AT RISK FOR PROJECTS LESS THAN $2,000,000 <br />AGREEMENT WITH WHARTON- SMITH, INC. FOR CONSTRUCTION <br />OF THE EMERGENCY GENERATOR REPLACEMENTS FOR THE <br />NORTH AND HOWELL PARK WATER TREATMENT PLANTS; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE <br />DATE. <br />WHEREAS, the City owns, maintains and operates three water treatment plants that <br />require continual operations; and <br />WHEREAS, emergency generators are located at each water treatment plant to provide <br />electricity during power outages to continue the provision of potable water to City customers; <br />and <br />WHEREAS, the emergency generators at the North and Howell Park water treatment <br />plants are nearing the end of their service life and require replacement; and <br />WHEREAS, on February 13, 2012, via Resolution 13 -2344 the City Commission <br />approved a continuing agreement with Wharton - Smith, Inc. (Wharton- Smith) for construction <br />projects valued at less than $2 million; and <br />WHEREAS, On December 9, 2013, via Resolution 13 -2557, the City Commission <br />approved Amendment #3 awarding design and preconstruction services related to emergency <br />generator replacements for the North and Howell Park water treatment plants in the amount of <br />$17,375; and <br />WHEREAS, On May 12, 2014 via Resolution 14 -2599, the City Commission approved <br />Amendment #5 to the Wharton -Smith contract to provide additional design and pre- construction <br />services for this project to incorporate connection of the Howell Park office to the emergency <br />power generator with this project; and <br />WHEREAS, Wharton -Smith has submitted Amendment #7 as a Guaranteed Maximum <br />Price (GMP) proposal to construct the emergency generator replacements for the North & <br />Howell Park water treatment plants for $697,385; and <br />WHEREAS, Public Works staff has reviewed Wharton -Smith Amendment #7 GMP <br />proposal and finds it favorable to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />
