ORDINANCE NO. 98 -917 AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING SECTION 3 OF ORDINANCE NO. 95 -851 (WHICH ORDINANCE CREATED THE CITY OF CASSELBERRY COMMUNITY REDEVELOPMENT AGENCY ( "CRA ") AND ESTABLISHES THE BOARD OF COMMISSIONERS OF THE CRA AND ITS AUTHORITY) TO PROVIDE THAT THREE (3) MEMBERS OF THE BOARD OF COMMISSIONERS OF THE CASSELBERRY CRA SHALL BE NOMINATED AND APPOINTED BY THE CASSELBERRY CITY COMMISSION AND TWO (2) MEMBERS OF THE BOARD OF COMMISSIONERS OF THE CASSELBERRY CRA SHALL BE NOMINATED BY THE BOARD OF COUNTY COMMISSIONERS OF SEMINOLE COUNTY AND APPOINTED BY THE CASSELBERRY CITY COMMISSION; PROVIDING AN EFFECTIVE DATE FOR NOMINATION AND APPOINTMENT OF BOARD OF COMMISSIONERS OF THE CRA; DELETING THE SAVINGS CLAUSE; PROVIDING FOR CONTINGENT FUTURE TRANSFERS; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, under Section 163.410, Florida Statutes, the powers conferred by the Community Redevelopment Act of 1969 are to be exercised exclusively by the governing body of a home rule charter county unless the governing body of such county, by resolution, specifically delegates the exercise of such powers within the corporate boundaries of a municipality to the governing body of such municipality; and WHEREAS, because Seminole County has adopted a home rule charter, it is necessary for the City of Casselberry, Florida, to obtain a delegation of the powers, through resolution, conferred upon Seminole County by the Community Redevelopment Act of 1969 so that the City may exercise the authority and privileges conferred by such Act within the City's Community Redevelopment Area; and WHEREAS, Section 163.410, Florida Statutes (1993), permits such a delegation to be made subject to such conditions and limitations as Seminole County may impose; and WHEREAS, the Seminole County Board of County Commissioners has, by Resolution No.
