Planning & Zoning Commission/ <br />Local Planning Agency <br />December 11, 2013 <br />Page 2 <br />conclusions of the staff report dated December 11, 2013, and the following conditions of approval that remain from <br />the December 15, 2008 Planning and Zoning Commission approval letter attached as Exhibit B to the staff report: <br />The applicant shall undergo site plan review within one year for the subject property in accordance with <br />Chapter IV, Section XVIII "Site Plan Review" of the Casselberry Unified Land Development <br />Regulations, prior to commencement of development. No activity shall take place on the properties <br />prior to site plan approval and site construction permit issuance. <br />This approval is for a maximum of 50 beds within the proposed Assisted Living Facility. This <br />development shall not be utilized for multi - family residential purposes. <br />The proposed Assisted Living Facility shall fully meet and comply with all applicable Certification and <br />Licensing requirements of the State of Florida including the Agency for Health Care Administration <br />(AHCA), Florida Statutes 408 and 429, and the Florida Administrative Code 56A -5 <br />The owner of the subject facility shall obtain a Business Tax Receipt from the City of Casselberry prior <br />to commencement of business operations. <br />No hazardous materials shall be used, stored or generated at the site. <br />A site and building permit shall be obtained from the City within one year and construction shall be <br />completed within two years of the date of this approval. <br />All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />In response to the Commission's question regarding the status on the site plan review of this project, Mr. <br />Sorensen stated that the applicant is securing his financing for the project but wasn't sure how quickly the applicant <br />was moving forward on the project. Mr. Sorensen said that a six month time frame for site plan review could be <br />placed on the conditions of approval; however, if the applicant did not meet that requirement this conditional use <br />would be null and void and the applicant could request another conditional use. <br />Mr. Meadows asked the applicant to come forward. The applicant was not present at the meeting. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward to speak against this <br />request. Mr. Fraleigh felt that the area was not compatible for an assisted living facility. He said the residents in the <br />area do not want an assisted living facility at this location. <br />Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. In response to Mr. <br />Casselberry's question, Mr. Sorensen explained that the extension is valid for one year and it only requires approval <br />from the Planning and Zoning Commission. Mr. Casselberry thought a site plan had been presented for this item at a <br />previous meeting. He said that he would not comment for or against the item at this time. <br />
