Planning & Zoning Commission/ <br />Local Planning Agency <br />June 12, 2013 <br />Page 9 <br />Mr. Jason Sorensen, Planner I, reviewed the information provided in his memorandum dated June 12, 2013, <br />to the City of Casselberry Planning and Zoning Commission (a copy is file in the Community Development <br />Department). Mr. Sorensen presented a PowerPoint presentation (a copy is attached and made a part of the <br />minutes). <br />Mr. Sorensen said staff supports a reduction to the tree replacement requirement to two trees (total of 5" <br />DBH) which can be achieved with the planting of 2 trees at 2.5" DBH each or 1 tree at 5" DBH based on staffs <br />acceptance of the applicant's replacement plan of shrubs along the entire front of the building, jasmine ground cover <br />in the front yard (or other improved landscaping), and irrigation to maintain healthy landscaping. He said the <br />applicant shall submit a replacement plan to staff for approval. <br />Mr. Meadows asked the applicant to come forward. The applicant was not present at the meeting. <br />Mr. Meadows asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh said at the <br />last meeting it was discussed that there is no continuity to the tree law. He said it was the Commission's <br />recommendation to provide what is being enforced to inform the residents and business owners of the requirements. <br />He said we need continuity. <br />He said the business owner is being penalized for removing a diseased tree. He said a healthy tree was <br />removed at a home on Seminola Boulevard so they could drive in the backyard and they were not penalized. He felt <br />there was a double standard. <br />Mr. Meadows said there are distinct rules for tree replacement. <br />A brief discussion ensued regarding the Planning and Zoning Commission's approval of the reduction based <br />on the submittal of a replacement plan, compliance through the code enforcement process, and adding a date certain <br />for compliance. <br />Mr. Meadows asked for a motion to address SPR 13 -06. Mr. Hale made a motion to approve SPR 13 -06 for <br />the property located at 4630 S. US Highway 17/92 tree replacement waiver request based on the staff <br />recommendations for tree replacement requirements and shrubbery or payment into the Tree Bank Fund for $1,672 <br />
