Mr. Champagne said he inherited this store about <br />5 months ago and Circle K wants to correct the problem. <br />In response to the Commission's question regarding staff's recommendations, Mr. Champagne said that he agrees <br />with staff's recommendations. <br />Mr. Hale asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. <br />Mr. James Fraleigh, 23 Teresa Court, Casselberry, Florida came forward. Mr. Fraleigh said he was familiar with the station. <br />Mr. Fraleigh said it is difficult to see the signs for the 7- Eleven site across the street from the Circle K. He felt the trees posed <br />a hazard to drivers trying to see the signs showing the price of the gas. <br />Mr. Fraleigh said trees don't belong blocking businesses. He said trimming the trees opened up the site so the <br />business can be seen from the street. Mr. Fraleigh said that the cost for replacing the trees on the site will be passed on to <br />the consumers. He suggested planting flowers, low plants and seasonal plants to improve the curb appeal. <br />Mr. Fraleigh said that the power company chopped the daylights out of the trees at the Bojangles site and nothing is <br />done about that. Mr. Fraleigh felt it was wrong to force Circle K to comply with the conditions of approval because it is not <br />being enforced across the board. <br />Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry felt there was <br />no reason to trim the trees that high. He said motorists are looking for signs showing the price of gas. He said it appeared to <br />be a healthy over trim of good branches. <br />There were no final comments from staff. Mr. Hale asked for a motion to address SPR 13 -09. Mr. Bryan said in <br />regards to SPR 13 -09 he moved that the Planning and Zoning Commission approve the staff recommendations to approve the <br />Restoration Plan attached as Exhibit D to the staff report which includes the planting of 11 trees (10 Crape Myrtles and 1 <br />canopy tree) and the 9 conditions of approval included in the staff report. Mr. Weinroth seconded the motion. The motion <br />passed unanimously by voice vote. <br />Seventh Item of Business: SPR 13 -10: Concord Tree Waiver. Tree replacement waiver request for property located at <br />160 Concord Drive. <br />
