CASSELBERRY CITY COMMISSION <br />Minutes of January 13, 2014 — Regular Meeting <br />Page 17 of 22 <br />Notice of Public Hearing: The Notice of Public Hearing for Ordinance 13 -1400 was advertised in the <br />Orlando Sentinel on Thursday, January 2, 2014. <br />Staff Presentation: Community Development Director Sandra Smith stated that this was the second reading <br />and public hearing for Ordinance 13 -1400 and gave a brief overview of the ordinance, explaining that the <br />proposed ordinance would eliminate some duplicative language in the City's Code relating to citations and <br />provide for the option of utilizing a Special Magistrate for code enforcement and nuisance abatement <br />proceedings in addition to or in lieu of a Code Enforcement Board. She advised that the Planning and Zoning <br />Commission had approved the proposed ordinance at its November 13, 2014 meeting and were providing a <br />favorable recommendation to the City Commission for adoption of the ordinance. <br />Budget Impact: There is no increase to the City budget. Use of a Special Magistrate will replace the need for <br />an attorney to represent the Code Enforcement Board at each meeting. The cost of the Special Magistrate will <br />be provided in lieu of a City Attorney at each board meeting. Based on information received, due to the <br />reduced meeting time with a Special Magistrate, the attorney costs will be reduced. <br />Recommendation: The City Manager and the Community Development Director recommended adoption of <br />Ordinance 13 -1400 on second and final reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 13 -1400. The following <br />individuals carne forward: <br />Mr. James Fraleigh, 23 Teresa Court, spoke in opposition to Ordinance 13 -1400, stating he <br />felt it took away the citizens' rights to have a part in governing themselves, and he did not <br />believe it would be cost effective as represented by staff. <br />Mr. John Casselberry, 700 South Lost Lake Lane, expressed some concerns about the <br />elimination of duplicative language in the Code, and suggested it would be good to also <br />include an option for a mediation process for code enforcement matters. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 13 -1400. <br />MOTION: Commissioner Solomon moved to adopt Ordinance 13 -1400 on second and final <br />reading, as presented. Motion was seconded by Vice Mayor Hufford. Motion <br />carried unanimously by voice vote 5 -0. <br />B. Second Reading of Ordinance 13 -1401— Amendment to the Official Zoning Map for <br />Properties located at 1815 SR 436 (Aloma Baptist Church) ZB 13 -02) <br />The City Clerk read Ordinance 13 -1401 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF <br />CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN ARTICLE IV, SECTION 2 -4.3, <br />UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS AMENDED AND SUPPLEMENTED; ESTABLISHING THE ZONING <br />CLASSIFICATION OF "PMX -MID" (PLANNED MIXED USE: MEDIUM -RISE) FOR THE <br />PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; PROVIDING FOR <br />CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. <br />
