CASSELBERRY CITY COMMISSION <br />Minutes of October 28, 2013 — Regular Meeting <br />Page 8 of 13 <br />MOTION: Commissioner Hufford moved to amend the Agenda to place Items 12, 14, 15, <br />16 and 17, Other Items, City Manager's Report, City Attorney's Report, City <br />Cleric's Report and City Conunissioners' Reports /Comments before Item 11, <br />Public Hearings, for consideration, to then be followed by the remaining agenda <br />items in order. Motion was seconded by Commissioner Aramendia. Motion <br />carried unanimously by voice vote 5 -0. <br />12. OTHER ITEMS <br />A. Request to File a Lien Foreclosure - 441 Jasmine Road, Casselberry, FL <br />Staff Presentation: Community Development Director Sandra Smith advised that this item was reviewed by <br />the Code Enforcement Board on October 8, 2013 and the Board requested at that meeting that the cases related <br />to 441 Jasmine Road be referred to the City Attorney to begin foreclosure action due to three outstanding liens <br />on the property. She added that the liens on the property currently totaled at least $14,720 and were continuing <br />to accrue daily as the violations continued to exist. She advised there were no mortgages or other <br />encumbrances which would take priority over the City's liens; that the cost of the foreclosure would be <br />approximately $7,000; and demolition costs would be approximately $4,500. She stated that the property was <br />valued through the Seminole County Property Appraiser's Office at $46,200. <br />Ms. Smith further advised that the property owners and heir had died and ownership had yet to be determined. <br />She stated since the problems continue to exist and the City continues to abate these issues, staff was <br />requesting that the City be allowed to proceed with foreclosure on this property. <br />City Attorney Reischmann added that due to the deaths of the property owners and heir an attorney ad litem <br />would have to be appointed to represent the unknown heirs, and that the cost for this would be approximately <br />$1,200. Ms. Smith advised that part of that cost was included in the $7,000 cost she had quoted earlier. <br />Audience Participation: No one came forward to address this item. <br />MOTION: Vice Mayor Solomon moved that the City file a lien foreclosure on the property <br />located at 441 Jasmine Road, Casselberry, Florida. Motion was seconded by <br />Commissioner Aramendia. Motion carried unanimously by voice vote 5 -0. <br />B. Cily Manager Performance Evaluation Form <br />Mr. Newlon advised that his contract as City Manager called for a performance evaluation to be conducted by <br />each Commissioner once per year during the first quarter of each fiscal year. He added that the contract also <br />called for the City Commission to agree on a format and a process. He stated that he was submitting to the <br />Commission a form that he was requesting be used to evaluate his performance according to eight job <br />dimensions. He advised that the process would be that each Commissioner would fill out the evaluation <br />individually and meet with him privately. Then, once each Commissioner was satisfied with the evaluation, it <br />would be forwarded to Human Resources Director Andy Brooks, who would bring it back to the Commission <br />with a quantified summary of all of the Commissioners' evaluations.
