RESOLUTION 14 -2566 <br />A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA <br />APPROVING AND AUTHORIZING THE EXECUTION OF A LOCAL <br />AGENCY PROGRAM AGREEMENT SUPPLEMENTAL NO. 1 WITH <br />THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION <br />FOR FUNDING THE CONSTRUCTION OF THE CASSELBERRY <br />GREENWAY TRAIL SECTION 3; PROVIDING FOR CONFLICTS, <br />SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS, trail systems provide an economic benefit to cities and neighborhoods <br />where trails exist and are a significant element of the City of Casselberry's Comprehensive Plan; <br />and <br />WHEREAS, the State of Florida Department of Transportation and the City of <br />Casselberry desire to facilitate the construction of Casselberry Greenway Trail Section 3; and <br />WHEREAS, the State of Florida Department of Transportation has requested that the <br />City of Casselberry execute Local Agency Program Agreement FPN 427900- 1 -58 -01 <br />Supplemental No. 1 and delivery to the State of Florida Department of Transportation so they <br />may provide funding of $1,450,514 toward the Casselberry Greenway Trail Section 3 project. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. The City Commission of the City of Casselberry hereby approves Local <br />Agency Program Agreement Supplemental No. 1, FPN 427900- 1 -58 -01 with the State of Florida <br />Department of Transportation and authorizes the Mayor to execute said document on behalf of <br />the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of <br />the provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV.
