ORDINANCE 13.1401 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY <br />OF CASSELBERRY OFFICIAL ZONING MAP AS ESTABLISHED IN ARTICLE IV, <br />SECTION 2 -4.3, UNIFIED LAND DEVELOPMENT REGULATIONS OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS AMENDED AND SUPPLEMENTED; ESTABLISHING <br />THE ZONING CLASSIFICATION OF "PMX -MID" (PLANNED MIXED USE: MEDIUM - <br />RISE) FOR THE PARCELS DESCRIBED IN SECTION I OF THIS ORDINANCE; <br />PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE <br />DATE. <br />WHEREAS, Aloma Church Properties, Inc. has requested a change to the zoning designation for <br />the properties described in Section I; and <br />WHEREAS, the properties described in Section I are within the corporate boundary of the City of <br />Casselberry; and <br />WHEREAS, such properties should be consistent with land uses of neighboring parcels to allow for <br />the most appropriate future development of the site; and <br />WHEREAS, the proposed PMX -Mid (Planned Mixed Use Medium -rise) zoning classification for <br />these properties, is consistent with the Future Land Use Map designation of "Major Thoroughfare Mixed - <br />Use"; and <br />WHEREAS, the Casselberry Planning and Zoning Commission /Local Planning Agency has posted <br />written notification on the property under consideration and mailed to all owners of record property within <br />500 ft of the property requested for rezoning; and <br />WHEREAS, the Casselberry Planning and Zoning Commission /Local Planning Agency has held a <br />public hearing with due public notice to consider this zoning map amendment; and <br />WHEREAS, the Casselberry City Commission has held a first reading of the zoning map <br />amendment; and <br />WHEREAS, the City Commission of the City of Casselberry, Florida has held a public hearing with <br />due public notice to consider zoning map amendments of the property hereinafter described and at such <br />hearing, interested parties and citizens for and /or against the proposed establishment of the City of <br />Casselberry zoning designation were heard; and <br />WHEREAS, after said Public Hearing, the City Commission of the City of Casselberry, Florida, <br />determined that the zoning designation of said properties provided in Section I, herein, shall be established <br />as PMX -MID, as that classification is defined in Articles IV and V of Chapter II, as amended and <br />supplemented, of the Unified Land Development Regulations, Code of Ordinances of the City of <br />Casselberry, Florida. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. That the Official Zoning Map established in Article IV, Section 2 -4.3 of the Unified <br />Land Development Regulations of the Code of Ordinances of the City of Casselberry, Florida, as amended <br />and supplemented, for the portion of the subject parcel, is hereby amended by changing the designation of <br />
