RESOLUTION 13 -2549 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF SUPPLEMENTAL AGREEMENT NO. 43 WITH CPH <br />ENGINEERS, INC. FOR TECHNICAL SERVICES TO COMPLETE <br />AND SUBMIT THE CASSELBERRY WATER RECLAMATION FACILITY <br />FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION <br />OPERATING PERMIT; PROVIDING FOR CONFLICTS, SEVERABILITY, <br />AND EFFECTIVE DATE. <br />WHEREAS, the City owns, operates and maintains the Casselberry Water Reclamation <br />Facility (WRF); and <br />WHEREAS, operation of the WRF requires an operating permit from the Florida <br />Department of Environmental Protection (FDEP); and <br />WHEREAS, the City's current FDEP Operating Permit is set to expire on December 15, <br />2014 and the City is required to submit the permit application a minimum of 180 days prior to <br />the permit expiration; and <br />WHEREAS, CPH Engineers, Inc. has submitted a scope of services proposal (via <br />Supplemental Agreement No. 43) for technical services to complete and submit the Casselberiy <br />Water Reclamation Facility Florida Department of Environmental Protection Operating Permit, <br />for an amount not to exceed $18,880; and <br />WHEREAS, Public Works staff has reviewed Supplemental Agreement No. 43 to the <br />Standard Consultant Agreement with CPH Engineers, Inc. and finds it favorable to the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION L The City Commission of the City of Casselber7y hereby approves <br />Supplemental Agreement No. 43 to the Standard Consultant Agreement with CPH Engineering, <br />Inc. for an amount not to exceed $18,880, and authorizes the Mayor to execute said document on <br />behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severability. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />SECTION IV. Effective Date. This Resolution shall become effective immediately upon <br />its passage and adoption. <br />
