RESOLUTION 13 -2537 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, APPROVING AND AUTHORIZING THE <br />EXECUTION OF AMENDMENT NO. 1 TO SUPPLEMENTAL <br />AGREEMENT NO. 2 WITH CDM SMITH, INC. FOR ADDITIONAL <br />SERVICES RELATED TO THE CITY OF CASSELBERRY 2012 -2013 <br />STORM DRAIN REHABILITATION PROJECT; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City's stormwater conveyance system is critical to proper drainage of <br />the watersheds in which the City lies; and <br />WHEREAS, several components of the drainage system have been identified by staff as <br />in need of rehabilitation and have been combined into a project known as the 2012 -2013 Storm <br />Drain Rehabilitation Project; and <br />WHEREAS, in October 2012, the City Commission approved Supplemental Agreement <br />No. 2 to the Standard Consultant Agreement with CDM Smith, Inc. (then known as Camp, <br />Dresser and McKee, Inc.) for Continuing Professional Stormwater Services to provide design <br />and post design services related to this project; and <br />WHEREAS, City staff and CDM Smith, Inc., after further evaluation of the conveyance <br />system, have determined that additional design services beyond the original scope of the project <br />are necessary, and, as a result, CDM Smith, Inc. has provided a proposal in the form of <br />Amendment No. 1 to fulfill said additional services; and <br />WHEREAS, Public Works staff has reviewed Amendment No. 1 to Supplemental <br />Agreement No. 2 to the Standard Consultant Agreement with CDM Smith, Inc. and finds it <br />sufficient to meet the needs of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION L The City Commission of the City of Casselberry hereby approves <br />Amendment No. 1 to Supplemental Agreement No. 2 to the Standard Consultant Agreement with <br />CDM Smith, Inc. for an amount not to exceed $57,555 and authorizes the Mayor to execute said <br />document on behalf of the City. <br />SECTION II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br />SECTION III. Severabilitv. If any Section or portion of a Section of this Resolution <br />proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the <br />validity, force, or effect of any other Section or part of this Resolution. <br />
