CITY OF CASSELBERRY CODE ENFORCEMENT BOARD MEETING MARCH 14, 2013 Accessory structure maintenance, ULDR Section 3 -10.3 A(6) Roof maintenance, ULDR Section 3 -10.3 ^ • CE -12 -02035 and CE -12 -02047 9 Carriage Hill Cir Mr. Hull, Code Compliance Officer, gave testimony for the above cases. Theodore Keller, 9 Carriage Hill Cir; Casselberry, FL advised the home is kept by he and his brother. Mr. Keller stated that both he and his brother have lost their jobs and are fighting for their lives. The inability to maintain the property is because of the foreclosure. Mr. Keller asked the Board for as much time as they could give, because they are working at this. The proposal after talking with contractors is the a -frame needs to torn down, what could be accomplished is demolition and get rid of what the problem is. MOTION: Mr. Smith moved to find Respondents in these cases in violation of the City Code as charged and that Respondents correct the violation before 1:00 p.m. on 05/17/2013. In the event Respondent does not comply by this date, a fine in the amount of $50.00 per day per violation will be imposed for each day the violation continues past the aforestated date. The Respondents are further ordered to contact the Code Compliance Officer to verify compliance with this Order. Mr. Herron seconded the motion. The motion did not pass unanimously. Mr. Bakalla voted nay. Outdoor sales, ULDR Section 3 -10.2 (5) • CE -12 -02295 2730 S Highway 17/92 Mr. Hull, Code Compliance Officer, gave testimony for the above case. Howard Lefkowitz, 2730 S Highway 17/92, owner of Ding Bikes advised he had a presentation for the Board. Mr. Leflcowitz advised that Ding Bikes has been in Casselberry since December of 2012; in that time several other notices besides the one at tonight meeting occurred. They have since complied as quickly as they could, they did not start out to do anything that was contrary nor do they intend to. Mr. Lefkowitz thinks there is something inappropriate with what they are being charged with being in violation of, which is what they discuss. Ms. Hale, Chairperson advised they were at the meeting to ULDR Section 340.2 (5). Mr. Leflcowitz read ULDR Section 3 -10.2 (5). Ms. Babb - Nutcher, Assistant City Attorney advised this was not the Planning and Zoning Board and to get the exception you have to go to the Planning and Zoning Board. Mr. Lefkowitz stated he understood, and he did not ask to come to the Code Board, they asked for an appeal to the Board of Adjustment. MOTION: Mr. Smith move that this case be abated (continued) for 60 (sixty) days. Mr. Herron seconded the motion. The motion passed unanimously. 6 1 P a g e
