CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />MARCH 14, 2013 <br />Accessory structure maintenance, ULDR Section 3 -10.3 A(6) <br />Roof maintenance, ULDR Section 3 -10.3 ^ <br />• CE -12 -02035 and CE -12 -02047 9 Carriage Hill Cir <br />Mr. Hull, Code Compliance Officer, gave testimony for the above cases. <br />Theodore Keller, 9 Carriage Hill Cir; Casselberry, FL advised the home is kept by he and his <br />brother. Mr. Keller stated that both he and his brother have lost their jobs and are fighting for their <br />lives. The inability to maintain the property is because of the foreclosure. Mr. Keller asked the Board <br />for as much time as they could give, because they are working at this. The proposal after talking with <br />contractors is the a -frame needs to torn down, what could be accomplished is demolition and get rid <br />of what the problem is. <br />MOTION: Mr. Smith moved to find Respondents in these cases in violation of the City Code as charged <br />and that Respondents correct the violation before 1:00 p.m. on 05/17/2013. In the event Respondent does <br />not comply by this date, a fine in the amount of $50.00 per day per violation will be imposed for each day <br />the violation continues past the aforestated date. The Respondents are further ordered to contact the Code <br />Compliance Officer to verify compliance with this Order. Mr. Herron seconded the motion. The motion <br />did not pass unanimously. Mr. Bakalla voted nay. <br />Outdoor sales, ULDR Section 3 -10.2 (5) <br />• CE -12 -02295 2730 S Highway 17/92 <br />Mr. Hull, Code Compliance Officer, gave testimony for the above case. <br />Howard Lefkowitz, 2730 S Highway 17/92, owner of Ding Bikes advised he had a presentation for <br />the Board. Mr. Leflcowitz advised that Ding Bikes has been in Casselberry since December of 2012; <br />in that time several other notices besides the one at tonight meeting occurred. They have since <br />complied as quickly as they could, they did not start out to do anything that was contrary nor do they <br />intend to. Mr. Lefkowitz thinks there is something inappropriate with what they are being charged <br />with being in violation of, which is what they discuss. <br />Ms. Hale, Chairperson advised they were at the meeting to ULDR Section 340.2 (5). <br />Mr. Leflcowitz read ULDR Section 3 -10.2 (5). <br />Ms. Babb - Nutcher, Assistant City Attorney advised this was not the Planning and Zoning Board and <br />to get the exception you have to go to the Planning and Zoning Board. <br />Mr. Lefkowitz stated he understood, and he did not ask to come to the Code Board, they asked for an <br />appeal to the Board of Adjustment. <br />MOTION: Mr. Smith move that this case be abated (continued) for 60 (sixty) days.
