CASSELBERRY CITY COMAIISSION <br />Minutes of Mareb 11, 2013 — Regular Meeting <br />Page 10 of 19 <br />OPEN BURNING, CHAPTER 42, FIRE PROTECTION AND PREVENTION TO PROHIBIT ALL <br />OPEN BURNING EXCEPT AS SPECIFICALLY PROVIDED AS REQUIRED BY STATE LAW; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS AND EFFECTIVE DATE." <br />Notice of Hearing: The Notice of Public Hearing relative to Ordinance 13 -1387 was published in the Orlando <br />Sentinel on February 28, 2013. <br />Staff Presentation: Fire Marshal Tim Ippolito briefly explained that this was the second reading of an <br />ordinance which was required by state law in order to enforce the local ordinance. <br />Budget Impact: There is no impact to the City Budget. <br />Recommendation: The City Manager and the Fire Chief recommended adoption of Ordinance 13-1387 on <br />second reading. <br />Public Hearing: The following individuals came forward to address Ordinance 13 -1387: <br />Mr. James Fraleigh, 23 Theresa Court, spoke in opposition to Ordinance 13 -1387, expressing <br />his belief that it would take away the rights of responsible citizens to have a small campfire or <br />cooking fire in their back yards. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 13 -1387. <br />MOTION: Vice Mayor Solomon moved to adopt Ordinance 13 -1387 on second and final <br />reading, as presented. Motion was seconded by Commissioner Aramendia. <br />Discussion: A brief discussion ensued during which Fire Marshal Ippolito clarified that this would, in fact, <br />allow campfires with a size limitation of 3 feet in diameter and flames no higher than 2 feet.
